    Tips on posting on the forums.

    1. Post a clear title like ‘Need help preparing PTSD claim’ or “VA med center won’t schedule my surgery instead of ‘I have a question.
       
    2. Knowledgeable people who don’t have time to read all posts may skip yours if your need isn’t clear in the title.
      I don’t read all posts every login and will gravitate towards those I have more info on.
       
    3. Use paragraphs instead of one massive, rambling introduction or story.
       
      Again – You want to make it easy for others to help. If your question is buried in a monster paragraph, there are fewer who will investigate to dig it out.
     
    Leading too:

    exclamation-point.pngPost straightforward questions and then post background information.
     
     
    Examples:
     
    • Question A. I was previously denied for apnea – Should I refile a claim?
      • Adding Background information in your post will help members understand what information you are looking for so they can assist you in finding it.
    Rephrase the question: I was diagnosed with apnea in service and received a CPAP machine, but the claim was denied in 2008. Should I refile?
     
    • Question B. I may have PTSD- how can I be sure?
      • See how the details below give us a better understanding of what you’re claiming.
    Rephrase the question: I was involved in a traumatic incident on base in 1974 and have had nightmares ever since, but I did not go to mental health while enlisted. How can I get help?
     
    This gives members a starting point to ask clarifying questions like “Can you post the Reasons for Denial of your claim?”

Settled @ The Bva


1994andcouting.....

Question

My case at the BVA was finally 'settled' on 9/8/09. Does anyone know what that term means? I tried to do a google search for the term on hadit.com from my phone last night but had major issues.

So if this has been posted before someone can post the link as my response.

Hi Betty (it has been a long time, thanks for responding) :P

I called the BVA status line on yesterday and she told me that it was settled on the 8th. She said that the letter would go out in 'todays' (Wednesday) mail but that she couldnt tell me anything on the phone.

I called the 800-827-1000 yesterday and was told the same. I called my VSO and he hasnt called me back yet.

Well, going by what you have said, I would guess that your claim has been "settled". That is all. It does not mean that you will be happy with the settlement. It could mean that you will be overjoyed.........................but, for now, it's settled.

:P Thanks Larry, I figured as much.

I know I havent spoken to anyone there so when I hear settled(in terms of lawsuits and things of that nature) I figure it means both parties 'agreed' to something.

I will wait on the letter (as if I have a choice) ha!

I have been remanded back to the RO via the AMC already. I was finally sent back to the BVA in June. Soooooo hopefully this is the end.

I"m still stuck in the BVA's remand to AMC & RO quagmire of shit.

Yesterday morning I called the 1-800-827-1000 number was informed that my case had been settled yesterday and I should get a letter within 2 weeks. Well I got home, and there was a message on phone from the DAV telling me that my claim will take more then a year B) . So, I called the 800 number back and they for about the first time had the same info as my morning call. Sometimes I just wonder if I made a big mistake going with the DAV :P . Now I know why I stgay in a confused state of mind.

Papa, thanks and WHOA!!! that is scary. I use the Texas Veterans Commission. My rep hasnt called me back yet, so I am wondering if that is a sign. He seems pretty focused and maybe doesnt want to deliver any bad news......Im biting my nails.

I hope yours doesnt take as long as they say. I pray it doesnt. Mine hit the one year mark at the BVA in February.

Just called the regional office and I was told that they cant 'see' anything (letters going out, ratings,etc) because my file isnt back from the BVA yet. That I should receive a packet in the mail soon and if I dont agree with the 'complete' decision it will give me steps on what to do next.

Hmmmm "complete" decision............Maybe two conditions (which are the ones that my VA doc said are service connected) out of the four I claimed? I wonder..........nervous and on pins and needles.........

Just watch for your mailman Saturday.

Everything I have ever received has always been on a Saturday.

I couldn't believe my large retro check was also delivered by my mailman on a Saturday.

I danced with that check all weekend trying to figure where to hide it.

I did live to make it to the bank first thing Monday Morning, but it sure was difficult.

WOW thanks Betty, I asked my kids to help me stay away from the PO box until Saturday. How ironic!!!! well one more day..........I have been shaking ever since I heard that term 'complete decision'. :P

PS My mail is normally in the box by 10 am and since my Credit Union stays open on Saturday until 1pm hopefully I wont have to wait that long IF I get a check like that LOL

I was denied on all my issues:

Degenerative disc disease

fibromyalgia

depression

lower back

I messed up by not going for treatment at the VA from 91-01. I was seeing private docs but I havent been able to find proof. Im still looking for my old medical bills and records but no luck so far.

However, the BVA did refer my recent PTSD diagnosis due to MST back to the RO for further development. Now I just have to wrap my mind around talking about that again.

Thanks to everyone for your support and I have learned a lot about the VA system being on hadit. I hope that no one gives up and that you fight until the end.

As for me Im going to hit the Hadit archives and do some research so I can know what Im doing on this PTSD claim. But I doubt if I will fight as long on this one because I dont know if I can anymore. This one may take the wind out of me which is why it took so long for me to say anything in the first place.

This squid girl has spent 15 years of her 39 fighting and Im tired. ;)

PS by the way I got the envelope on Friday. :D

That is how they did me. I think if it comes to quick it will typically be a denial. I would however get some specialists opinion and appeal to the CAVC. Remember the persistent get paid because they don't have enough to pay everyone.

Thanks Mike R, I thought about having an attorney look over it. I will think on it some more, but me doing it myself, Im beat. Sad but true.
