Bio:

Mr. Rosinski is one of the nation’s leading practitioners of veteran’s benefits law, representing veterans and their families before the Department of Veterans Affairs (VA) and federal courts.

At any time he has cases in the Court of Appeals for Veterans Claims, the Board of Veterans’ Appeals, and VA Regional Offices.

Mr. Rosinski is co-counsel in the In Re Department of Veterans Affairs (VA) Data Theft Litigation class action which obtained reportedly the largest Privacy Act claim settlement in history.

He has also litigated cases involving government officials blocking of benefits claims regarding the adverse health impacts of atomic, biological and chemical testing on unknowing military personnel.

Mr. Rosinski’s other primary practice area is in the regulation of energy production facilities.

He has extensive and varied experience with Nuclear Regulatory Commission (NRC), Federal Energy Regulatory Commission (FERC) and Department of Energy (DOE) regulations, oversight, and enforcement.

Prior to joining Ogletree Deakins, Mr. Rosinski spent eight years practicing energy law in Washington D.C. assisting applicants, licensees and others in resolving technical, management and regulatory issues under close scrutiny from those agencies and outside interveners.

Mr. Rosinski has also assisted clients in investigating and defending enforcement and employee concerns matters, preparing for regulatory audits, responding to regulator inquiries, and developing internal compliance processes and procedures.

His clients include commercial utilities and facility operators, industry issue groups, management and operations contractors, and municipalities.

Prior to practicing law, Mr. Rosinski was an officer and qualified nuclear engineer in the U.S. Navy submarine force and obtained over 16 years of experience in licensing, startup, operation and safety oversight of nuclear and other technical facilities before becoming an attorney.

Thanks for the Bio Carlie- he was a superb guest and the show went by TOOOOO Fast!!!!!

Although we discussed Atomic vets and the problems they have with their claims and the DTRA dosage criteria-he has certainly helped some atomic vets (and one of the widows I mentioned on the show)

succeed in proving their disabilities were due to radiation.

Jerrel asked him question I had discussed with him earlier on Wednesday-

will VA consider CHD (congestive heart failure) as ischemic heart disease per the new AO presumptives?

Unfortunately Doug said no these are different disabilities and this is the problem many advocates have hinged on regarding the new ischemic heart disease addition to the AO list.

CHD could possibly have a medical relationship to ischemic heart problems and ischemic heart disease seems to be the most prevalent type of heart disease in the USA.

Still-what types of heart disease will be found by VA as not consistent with ischemia of heart?

This was wonderful news on the new presumptives but having been around the block a few times- I am very concerned as to how the VA will handle AO heart disease claims.

DMII can certainly cause ischemia as well as high cholestrol and numerous other things.

I will be anxious to see how VA will define cardiac ischemia for AO claims purposes.
