Claim Decision Brokered Out?

Question

Hey have a claim in for IU after biegn already rated at 30% for PTSD(called adjustment disorder), claim also includes TBI and is residuals, When i call the 800 # they tell me in august it was brokered out to another office for a descion to be made. That happened in august and They are still telling me the same thing does anyone have any experience with a claim bieng brokered out from one office to another and if so how long will it be before a descion.

Yes, they do it all the time. They pass the claims around from one maxed out VARO to another. I guess this shows action. If they send it to the ST. Petersburg VARO fall on your knees and pray to the good Lord that your claims comes back.

Ditto on John999's post.

If you are currently 30% SC'd - in my opinion you have a long way to

go prior to getting IU granted.

I only know of a few claims for IU being granted as extra-schedular,

by way of another Hadit member, as it does not happen often.

Probably for you to get IU granted you will have to get increases in your

current level of SC first.

It's like climbing up a ladder --- v e r y s l o w l y.....

If the VA really intends to grant IU they will first bump you up to 70%. I filed when I was 30% and they bumped me up to 70% and eventually granted IU. Not without a long drawn out fight, however. I started at 10% and got bumped and lumped all the way to IU.

Initial claim in 07' was for ptsd got rated at 30% SC in DEC. of 08. I Filed for IU in Feb. first just based on ptsd asking for 70% plus 30% for iu. however In april I added the TBI and residuals after finally getting a TBI screening and a mri. my doctor told me to file for it. I am aware of the ladder to climb hoping the tbi and residuals get approved with no problems and help my % along. Stress of waiting on the descion now i getting to me a little.

Have you actually had a C&P done yet for TBI, this is different from a TBI screening.

Have you gotten or requested copies of your exams, MRI's,any C&P's etc...

that have been done.

Have you ever gotten a copy of your claims file ?
