I Won My Appeal, Now What?

Rate this question

Question

I just received notification from the BVA that I am entitled to SC for hypertension, to include as secondary to SC for OSA and PTSD from an appeal of a denied clam for hypertension in 2004, and from a denial for SC for hypertension secondary to PTSD and or OSA in 2008.

The letter from the BAV stated that my records are being sent back to the VA office that has jurisdiction over this matter. What happens next? The letter from the BVA did not state what percentage of disability for hypertension have been awarded, will the RO?

Patience.

The BVA granted service connection and now the issue will be reviewed to determine a disability rating.

Depending on the issue and evidence, you might be rated without a C&P exam.

If not, they will schedule you for a exam and then properly rate you.

Hypertension is normally rated at 10% my Hypertension was awarded along with CAD secondary to PTSD on April 7 they then sent my file back to the VARO on June 4 about 3 months later I got the award letter from the VARO and the backpay Congrats on your victory now if you have a heart attack or other cardiac problems it willbe much easier to get them to service connect it, of if you die from aheart attack it now has the door open to your spouse to obtain DIC much easier than fighting this fight after you pass.

RichL,

The RO will decide your percentages.

HI,

My claim file left the BVA and went to the R.O. It took about 3 months for them

to decide my rating and the amount of my retro pay.

Did the award letter state if you claim was re-opened to the first date you filed.

Ours was similar in that I had " New and Material" Evidence never seen by the VA before

which re-open my claim of 1992.

I am sure some one on the board will know about the effective date.
