Just got letter from V.A.

Dear Mr (Tinkerer)

We have received your compensation claim for ischemic heart disease based on herbicide exposure. However, this disease has not yet been added to the Department of Veterans Affairs regulations governing diseases presumptively associated with herbicide exposure. In order to add this disease, we must follow a series of legal requirements, including publishing a notice in the Federal Register. We have begun this process, but are holding your claim until these requirements have been met. When the process is complete, we will make a determination on your claim and provide you with a notice of our decision.

My guess, enough of us have not died of this yet so let's wait a couple of months!!!!

They have to ask for Public comment, then put it into the 38 USC, 38 CFR and then amend M21-1 to cover the regs.

As long as you were exposed to dioxin in Vietnam or meet the Korea AO regs you should not worry about the claim.

I filed a claim for IHD on the 9th of this month through advice of my VSO. I started having heart problems in 1999, first stent in Feb. of 2003, 2nd in Nov. 2003, 3rd in 2005, and a heart attack in Jan., 2006. (4th stent) My cardioligist said that I should be put on total disability. I filed a claim for this through SSDI and was denied 4 times. The fifth step is to file a civil case in federal court against the social security adminisration. Now we all know who's going to win that one. B) I couldn't find a lawyer anywhere that was willing to take them on in federal court so I just said heck with it. I'll be 62 in less than 3 years anyway.

I had a son who died shortly after birth from multiple birth defects and my oldest daughter was born with two heart deffects. When I get blood work done, I'm always told that I'm border line diabetic. I've been told by others that there is no such thing. You either are, or you aren't diabetic. I also have COPD with cronic bronchittis and glucoma.

I have filed for a claim too for IHD. It will be interesting to see what kind of a reply I receive. I have to agree with Dave on his comment about not enough of us have died yet to make a decision. I'm guessing 30% compensation. I have 4 stints currently and have an appointment with my cardioligist on the 11th of December. Can't walk more than a block and 1/2 without getting chest pain. Taking a nitro relieves the pain though.

When is last time the VA gave you HBIAC test for glucose?

Do you have copies of blood work from the VA? If the glucose levels fall into the ADA criteria you are a diabetic.

The Vietnamese have high incidence of birth defects in children that they attribute to AO. The Hatfield study of about 2 years ago found Danang's dioxin level is 300 times higher than it was during the War.

To the best of my knowledge the VA hasn't ever given me a HBIAC test and no, I don't have any copies of any blood work taken at the VA.
