Can You Apply And Work While Waiting?

Question

A friend was over yesterday and told me that they applied for SSD and kept working until right before their first payment. I checked this website and Social Securitys website, but couldn't find anything that said yes or no. So how many people have applied for SSD and kept working?

I am 60% VA, finding it harder and harder to work everyday....Thanks

Can I ask what is making it harder for you to work? What is your disability? And what type of work do you do? Are you taking off work a lot? Do you need special accommodations to keep doing your work? What is making it harder for you to work?

Technically, you can, but I wouldn't do it, if I were you. SSDI requires that you be able to work 8 hrs a day, 5 days a week or 40 hrs a week. If you are unable to work, a 40 hr week. due to your disability then you are considered disabled.

My back is the problem.....there is a thread on here about it someplace. To save you from searching, 5 Herniated discs, 4 bulging discs, Ostioarthritis, Disc degeneration, Canal Stenosis, Spinal Stenosis, Sciatia, and Neuropathy. I can work one maybe two days without killing myself, but then I have to up my pain pills. Pain pills are the only way I can make it through a week of work.....some weeks are worse than others depending on what I am doing. I am a Wastewater Treatment Plant Operator. I am in a lot of pain all the time, but I just keep popping the pills, to continue working to support my family.

I worked all the years since 69 sc injury with pain,(over 35 yr period) disabilities, more pain and finally had an operation which left me totally disabled...I was in denial thinking I would recover...never happened had to resign my state position and waited a year, finally listed in chart by dr's "you will never be able to work!"

So I filed for SSDI and was granted in weeks post exam, they advised me to file for VA, but I waited, still thinking this was just a temporary disability/knowing that it was permanent, waited and about a year filed VA...had alot of downs and only 2 ups...50% and claim at BVA.

I am from the old generation brought up to work through the pain, continue to work till you can't function...I wish I would have known then what I do now...maybe things could have been different or at least maybe the outcome would not have been so dismal. No you cannot work and claim SSDI. If you are awarded SSDI, they have a program back to work where you can try to work and if you can then you are d/c SSDI but if you can't then your SSDI continues but you better not work.

Many vets receive 100% TDIU yet have difficulty...the opposite is true too/esp if what SSA granted is not sc.

I wish I could work...I lost myself when I became disabled.

To make it clear, I was meaning apply for Social Security Disablity while still working....with the plan to quit or retire when it is granted.....by some of the comments I think I might have confused a few people....sorry for the confusion.

I don't make many post here, but I do read them all....I'm going to be blunt & frank here, and I hope I am not breaking any rules so I going to try and put it in a nice way. If your friend is working while applying for disability I would say he is a FAKE(would like to use words like maggot, swindler , or a few other choice words but I don't want to offend anyone) and makes it harder for those that really need it to get it. He will probably work after also and hopefully he gets caught...I sure as heck would turn him in. I already get ssd so I am replying for people that are trying to get it because they CANNOT work. Mods-if I am out of place then delete my post and I apologize for speaking my mind.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
