Hello,

I am new here and it looks like I have a lot of reading to do to catch up. I have a 60% SC on my lower back and I have put in for Unemployable because of it. By reading about everything in the fourm I am hoping not to make the common mistakes lesser informed veterans make.

Is the pay the same for a person at 60% unemployable as a person at 100% total permenate disability? I ask this because I am 60% on just my lower back but I know I can claim other things like my leg pain, loss of feeling in my feet and so forth and so on but I don't want to go through the whole gammit to claim all of these other things if the pay is the same. I know on thing for sure is that I can not keep working any longer, I was let go on Dec 1, 09.

Do you mean you filed a 21-8940 TDIU application?

TDIU is paid at the same rate as 100% COMP.

Welcome here. Have you also applied for SSA disability benefits?

Welcome to Hadit. Be sure and fill out the application and also file for Social Security. 60% pays same as 100% with TDIU.

Welcome to Hadit.

Individual Unemployability (IU/TDIU) pays at the same rate as 100% compensation.

When a VA claimant is granted Permanent and Total (P&T) that is a different

situation as it grants additional benefits such as Chapter 35

Dependents Educational Allowance etc...

In some states VA compensation at 100% P&T also allows for even more additional benefits such as no property tax on the personal residence etc...

Can you provide more detail on "I was let go on Dec 1, 09." ?

Hi and welcome to Hadit.

What evidence have you submitted favoring your claim for IU?

Here's a list of evidence that's supportive for IU. You can also get IU with P&T just to let you know. IU with P&T gets you all the same benies as having a 100% rated condition with P&T.

1. SSD award for same service connected condition. In your case: back problems

2. An evaluation that says you're unemployable for any work due to your service connected conditions.

3. If you've been denied voc rehab this is great evidence.

4. If you had to leave your last job due to your SC condition this is great evidence. Here's the form for your last employer to fill out and then submit it. The VA will request this down the road anyway so you might as well get this zonked out now.
