Question

I am wondering if anyone has been through something similar. I was awarded a P&T letter in September of 2007 and another in October of 2007. VA now says that I am not P&T, but I recently received the yearly statement of benefits and it says Permanently and totally disabled from service connected disabilities. I called the 1-800-827-1000 number, and they again state that I am not P&T. I said heck with it, and have applied for P&T based upon recommendation of my VSO. Anyone else ever go through this? Thanks very much.

Have you gotten anything from the VA saying you qualify for Chapter 35? If so, you are P&T and the 1800 number personnel don't know squat. I try to avoid that number unless it's totally necessary.

Hi Jerr. Thanks for the response. I did at one time receive a letter indicating eligibility for CH 35, and also a form to apply for CHAMPVA. When we applied, they said I was not P&T. I have now applied for P&T and have an independant evaluation from a private facility with a GAF of 41 saying that I am unemployable. My doctor at the VA also gives me a GAF of 46 and has indicated in records that I am totally disabled and unemployable. I guess I can only see what happens.

If yes, I would go in person to my RO with it.

Hi Carlie. I have presented all of the information when filing for P&T. But they have me scheduled for another C&P for PTSD and Diabetes in February. We shall se what happens. Do they ever follow Federal Statute? If so, I have never seen it. Thanks very much for the response.

They also need to say you're permanently disabled too. You already have the totally disabled part done just need that permanent word put in there somewhere. If you can take the eval back to your doctor and let him do an addendum (change) and put permanent in there too. I take it that the VA has already declared you unemployable from seeing that you're already 100%.

Of course all this is mute point if you're already P&T. Let us know.

Hello again Jerr. Now for another good one. They recently changed the unemployable rating to 100% Schedular. But a statement of benefits received afterwards states P&T. I am totally confused, but they have scheduled a Re-Exam for February, so we shall see. Thanks again for your response.
