What Affect Does Voc Rehab Have On Tdiu Claim

Question

Greetings,

I hope that someone can offer me some type of advice. I have a service-connected disability rating of 10% (PTSD)(2007), which is grossly underated. Against advice from a local vet rep because she said I would surely be denied, I applied for Ch. 31, Voc Rehab. in 2009, I was found to be entitled to Voc Rehab, the counselor that assessed me, was very distraught at the fact that I was rated 10%.

While being assessed, she made extensive notes stating that I was unable to work due to my service connected disability, although rated at 10%, my condition presented a great barrier, and even though I was approved, I would require EXTENSIVE counseling and I may not even complete the program.

After reviewing guidelines, in order for a Veteran to be rated at 10% he must present MILD symptoms. Since being discharged in 2004, my symptoms have been severe, documented by doctors.

The Voc Rehab counselor told me to file for an increase IMMEDIATELY, which I did in March 2009. My claim is currently at the review board. I have done extensive research, reviewed medical records, and submitted solid evidence, with guidelines, and references which pertain to my case.

I recieve SSD, and have not worked since 2006. I know that there are certain requirements that must be met to qualify for TDIU, and currently my schedular rating is below. I also requested TDIU based on Extra Schedular considerations. I have a Medical Verification form, from the VA doctor stating that I am PERMANATELY unable to work due to my illness.

This is my first time applying for an increase. Do you think that the records from Voc Rehab will help my TDIU claim?

Jerr:

Your ignorance can be very costly to Veterans on Hadit. Quit making things up with nothing to back it up but your opinion. You are very wrong and could mislead Members.

I recommend to all Members that before they make a decision to make sure that it is backed up by more than someone's opinion.

Voc Rehab will not cost a Veteran TDIU. Most of the time it is merely a plan to rehab a Disabled Veteran so that they can get a job. From the get go it is saying that the Veteran is unemployable without further training.

Pete,

I totlly agree, this is not the first time jerrbilly has had diarrhia of the mouth on a topic he knows nothing about, and it is clear he is mostly speaking out of his @ss. I don't know where this guy comes from but everyone be ware, this guy is trouble...

Most TDIU vets have low gaf and I can guarantee very few of them were done by Mr. Humphrey. No disrespect, but if you look at past TDIU grants most have low GAFs.

Point is, a doc or rep saying they can get a vet 100% with a 50 or lower GAF is, i imagine, is normal since a 50 or lower gaf has in it you "cannot hold a job"

Pretty clear here?

Actually GAF has nothing to do with it. It is based for some PTSD claims but TDIU is awarded to people who have physical and mental disabilities. I saw a breakdown somewhere but I assure you that the Physical disabilities outnumbered the mental by a very large percentage.

Ollie, I applaud you for seeking to better yourself. At lkeast you will have something to fall back on and I dont think it will be an issue with IU. that will be based on medical opinion and not on Voc Rehab.

Ok, I should have clarified. "most TDIU vets that are service connected for a MENTAL CONDITION. Of course a gaf wouldn't have anything to do with physical disabilities.

sorry

Jerr,

You know I've sat back and watched you open your mouth on topics it was clear that you know nothing about. Yet you continue to babble and I, among many do not appreciate your BS. You give advice like your all knowing... People come to this site for help, guidance, and moral support, but not the BS you are throwing around. You brought it on yourself now deal with it. I hope you take this to heart and realize the posible damage your "opinion" might bring to someone who trusts what you say, thinking you know what your talking about when you actually don't.

I for one don't care for the "know-it-all" who has an opinion for everything and again warn everyone, when it comes to your advice.

Take care,

Bergie

Berge, I'm very sorry you don't appreciate my input here. You could PM me anytime and we can talk this issue out if you want. It would be good therapy.

I'm a little concerned on why you all of a sudden verbally attacked me when you could have sent me a PM and gotten this straightened out without setting a bad example for others here.
