Claim On Docket At Bva

My CUE claim was placed on the docket for the BVA. I got the letter today. I will be dead or insane by the time I get a decision. From the time I filed it till I get a decision from BVA will probably be 4 years. Two rejections at the VARO and then a BVA Hearing and now it is on the docket? What was the hearing for I wonder? For crying out loud I thought the BVA judge at the hearing could make a decision. He got the brief and heard my case. I knew the hearning was quick, but I did not think it was just a milestone on the way to a long,long wait for the BVA to rule. I never actually got a personal BVA hearing before.

Ya gotta just love those. I have been through this before. I called em once a month it drives em nuts. I have had a remand in there since 04 it's just now in post. It appears that they now have all my ducks lined up and are getting the legalese written down before they send my rating. Or deny it. Then back to the VARO for round 4. As my condition worsens. The closer you get to 100% the worse it is. But that's just an opinion.

Yes, the RO/BVA/Remand/RO cycle really stinks. We have to break out of that cycle or it could go on forever. I hired a lawyer so he could think about the legal side.

He said the error was so obvious that if we did not win he would never do a CUE claim again. Really, I don't give too much of a damn if I win or lose since I got IU already. I would like to get that retro, however. They screwed me so badly back in the day.

John-I thought if you had a hearing already at the BVA that it already went on the BVA docket long ago?

My CUE filed in 2004 is still at the VARO.(I think)

I better check into that.

John - I think my BVA traveling hearing was in '94 and I don't think the decision, a remand, was made until '96 or '97, which was then denied, by RO, and back to BVA where I won retro to '89, in '99. Hang in there!!! Just outlive the process!!

O.K. I am going to start living right, so I can outlive the process, so that I can finally get the proper rating after 40 years. I'm gonna live right, do right, so I can die right. I would say that a traveling board via the BVA is a waste of time. My board did not last 20 minutes. I waited about 8 months for the hearing, and now I go on the docket for 2-3 more years. I will just check every 6 months to see where my claim is at the BVA. Talk about a dysfunctional system designed to delay and starve out vets this has got to be it. Lucky I am not waiting on this to pay bills. If you use all the tools in the appeals process including DRO, BVA, I bet you are looking at five years, or longer. That is unacceptable for a reasonable mind. How many vets die along the way?
