Just Had C & P Exam

I had my exam for SC psych problems this week. I am feeling very apprehensive as the reviewer seemed to be very biased. They did not take many or any notes on all the things I was talking about to support my case, did not note that a civilian pscy I was referred to had been located and mailed a letter. When I referred to what appeared to be about seven pages of mental health visits in my records they said 'they didn't make many notes' - of course not, since these were two-striper technicians for the most part, and not modern doctors dictating reports.

Near the end of the exam I mentioned something about a friend that had nothing to do with my family history and they noted it apparently in relation to alcoholism in family, then got up and left the room to indicate that the meeting was over.

Can I get a copy of whatever report they write? I was told by my vet rep at the state office of vet affairs that we can review the exam and request another if it was not done properly.

Request a copy of the exam by submitting a 21-4138 to the VARO where you had the exam. Just state that you are requesting a copy of your C&P exam on date xxxxx. Worst case scenario don't get discouraged if you are denied or low-balled on the percentage if you get any percentage. I say this because they want you to get angry and walk away. Remember you have 1 year from the date stamped on the statement of the case(SOC) to file a notice of disagreement(NOD), and develope your claim.

My VAMC C&P office told me the docs have 10 business days to complete the C&P exam report. Sometimes they finish it earlier than that, depending on the circumstances. This gives them time to dig through your C-file and medical and prescription records.

They need to submit a signed and dated ROI form.

A 21-4138 will not cut it.

Hey folks!

Just thought that I stop by and see what was transpiring...and came across this thread. Hmmmm...I like it when someone is bashing a Clown & Peon exam!!! This gives legitimacy to MY argument.

As you may be aware, I've been SLAPPING the VA in their face about this particular topic.

It may interest you to know what has transpired in my claim in the past month...

As I have mentioned on another thread, I REFUSED a C&P exam based on the fact that I believed that the examiners (if you want to even call them this) couldn't render an accurate diagnosis to save their life! Some of these so called doctors cannot diagnose a hangnail!

You see, I have Orthopedic/Neurological connected problems. My local clinic has NO ORTHO/NEURO doctors, qualified enough to render an accurate assessment. Therefore, with that knowledge in mind (and it is FACTUAL...I checked), I refused said exam. A good number of people had mentioned that I shouldn't, but, read on...

A few days later, a young man (Scott from W.Virgina AMC) called me and asked why I refused the C&P? He was Polite, Courteous, Professional, and most importantly Personal, when I described my reasons. He related with me, being that he has similar Ortho problems. We sat and conversed for about :20 minutes or so about our ailments. We were also in agreement with each other, which shows that there ARE people there with your particular ailment that can and will relate to you.

Anyway...

He told me that he would inquire about this, and see if he could set an appointment with an Ortho dr. in Salisbury VA Hosp. A week or so later, I called back, and asked Scott if he was successful in locating a VA dr...he said NO!

I told him that I was willing to cooperate with the DVA, BUT, ONLY IF they can schedule me to see an Ortho dr.

I also told him, that in the REAL WORLD, people with a sore throat, do not see a Gynecologist, so why should I see someone w/o Ortho specialization?

He said point well taken, and he agreed, that I have a legitimate beef/argument. Therefore, the record stands, that there isn't a qualified specialist capable enough to render an Bona Fide opinion, regarding my ailments, AND that my refusing to attend a Clown & Peon exam were for good reasons!

I may have started a new trend here, because if you are scheduled for a C&P exam, and the doctors at your clinic/hospital do not have the appropriate education/knowledge/experience in your ailment, are you going to receive a fair exam/opinion?

HINT: Call before you attend this exam, and ASK if that particular doctor has the appropriate knowledge/education? Then, if he or she doesn't, ask them if they can schedule you to someone who does.

If they can't comply to such a reasonable request, REFUSE such an exam. When they come calling or writing and ask WHY?...Tell them the TRUTH: "...that there is no one qualified enough to render a fair and just opinion pertaining to my particular condition(s)!" Remember, the dr. scheduled to conduct your exam MUST be 100% knowledgeable enough with YOUR PARTICULAR CONDITION.

NOTE:

DO NOT use this argument if you simply missed the exam, to later find that there IS a doctor present that has knowledge of your ailment. The DVA WILL deny your benefit!!! The rules are specific that if you miss a C&P exam, it could have an adverse effect on your claim!

Do it EXACTLY as I did, with communications, written and verbal, and if the rep sees that you cannot get examined fairly, then you have a legitimate excuse. Insist that this conversation (as to WHY you didn't attend), is clearly documented.

Also, inquire about this with your Service Officer, and if need be, go to see a VA rep directly and explain it in detail, as I did.

The DVA cannot deny you, if you and the reps made efforts for you to receive a fair exam.

In my opinion, it is better to not go, using my methods, then to attend and receive a wrong or biased diagnosis. Simply put, the more crap you have in your file, the harder it is to obtain benefits in the future. Keep in mind, that examiners look at your history and render an opinion based on what past doctors have stated!

Additionally, if your ailment is Ortho related, then INSIST that a Geniometer is used during the exam!!! The DVA insists that ROM is accurately assessed with this device, and that ALL doctors use it.

Not ONE dr. that I've seen ever used one to render an accurate ROM.

IF this ends up in Federal Court, this gives me the advantage, that ALL past opinions rendered by the DVA, is and should be considered as MOOT, until it is PROVEN that those doctors were qualified enough to render a correct Ortho/Neuro diagnosis.

Finally, and back to Scott @ the AMC...

I asked Scott if he would be so kind as to notate this on his report as to WHY I didn't attend. He assured me that he was going to write up a report in my favor, specifying that the Veteran has a legitimate reason for not attending, and that aside from the VA hospital in Durham, NC there are no immediate Ortho drs. to conduct a bona fide exam!

Do you all see what a Logical conversation can do to avoid the biased, uneducated opinions rendered by some of these quack doctors?!

Keep in mind, that I informed the DVA (written & telephone) that I WAS willing to cooperate, ONLY IF a qualified doctor was to examine me! Don't send me to an "Ears, Nose and Throat" doctor for an ortho/neuro related problem.

Like the original author of this thread, I TO possess opinions that make NO SENSE whatsoever. This letter (by Scott) alone could and I hope WILL quash the past opinions rendered, especially if the DVA digs deep enough to find that a General Physician rendered a biased opinion, and did not possess the appropriate knowledge of Orthopedics/Neurology.

Note: In my 1997 C&P exam, they did not use a goinometer. However, in my C&P exam last month, they did. I didn't ask them too either.
