Question

I received a letter from my lawyer on Friday. My hearing is scheduled for June 5th and I am already nervous. I am now at the point where I can't go out in public without my wife unless it is an extremely short trip. I get panic attacks which turn into anxiety attacks if she is not there. The attacks lead to stress induced migraines. I also have physical problems that keep me from standing in one place for any more than 15 minutes, walking very much, or sitting in most chairs for more that 1/2 hour. I can't lift more than 10 lbs repetitively either. I just hate to go through this.

As your question is posted in Social Security Disability Questions, I am assuming that your hearing is going to be before an Administrative Law Judge (ALJ). This is your chance to to talk to a REAL person about your case. You need to talk about the problems you are having, like you were talking to your lawyer; explaining what you can and can not do, and why. There will be the ALJ, a recorder, your lawyer, you and possibly a vocational specialist in the room. The ALJ may or may not let your wife testify in your behalf, because he already has reviewed all the paperwork your lawyer has sent him. At my hearing, my wife wasn't needed to testify, and she just waited in the waiting room. Once, your hearing is over, you will probably have to wait 6-12 weeks before being notified of the ALJ's decision. My hearing was just over 5 weeks ago, and I am in the waiting stage, hoping for a favorable decision.

Have you asked your lawyer if you have to be present ?

I had an SSA - ALJ Hearing a few years back and I did not have

to be present, the law firm I had chosen represented me at the

hearing along with my medical evidence and my SSD was granted

as fully favorable.
