Got an out of the blue phone call from my VAMC last week. Seems the VARO had ordered a C&P for claims that they had previously and seemingly arbitrarily denied without a C&P. The claims are related to IHD and DMII as secondary. There is still no "final" just "proposed" regs concerning IHD. IHD was not mentioned in the call. There is an active claim for IHD. My medical history fully supports 100% for IHD, and the combination of DMII and IHD, as well as treating physician's IMO's (that the VA previously ignored) support secondary conditions. DMII is currently SC'D at the usual low %, so I have no choice to show up for the C&P. Again, the VA has a C&P test scheduled that is clearly not appropriate, based upon my medical history and VA regs concerning IHD.
Anybody have any ideas as to what scheme the VA has cooked up now?
Did somebody review my file, due to the IHD claim, and say oops, we screwed up?
Without the presumption for IHD, I was/am facing a long and drawn out CUE process.
(Due to the VARO claiming that they never received a hand delivered NOD.)
Maybe getting a lawyer involved, filing for IHD in October 09, and changing my "representative" from the state/VFW VSO to the lawyer toggled something?
Is the VA doing and end run around the secretary's letter concerning IHD and C&Ps?
Deny, Delay, Obfuscate and Hope they Die may be the new mantra?
