Phone Call From Amc To Sign And Fax Document For Board Of Appeals?

Question

Guest RJMacReady

I received a rather strange phone call from the AMC(Appeals Management Center)? to sign and fax a document referred to as a '30 day waiver letter'? for the Veterans Board of Appeals???

I presume that this means that my claim is denied again; which would be rather preposterous given that the injuries are all well documented and obviously occurred as a direct result from performing my duties in the military and through no fault of my own.

14 years of waiting and nonsense and even an apology letter from the VA that it has taken so long for my claims and for losing my records as well; so the VA requests C&P Exams again stating that the rating system had changed significantly since the last time that I submitted my claim and so I complied with their request and sounds like just to get denied again. This is absolutely unbelievable, apparently this must be how the VA gets rid of wounded vets with legitimate claims, they just keep denying your claims until you give up???

Have you received anything else from the AMC at all?

Did they farm out the claim and order another C & P? Did they issue a SOC or couldnt the person tell you that one is coming.

Do you have a vet rep?

Yes- I too was a claimant 14 years ago and then again in 2003.

.

The claims process has changed significantly and has grown by thousands and thousands still waiting.

It took them almost 7 years to read my evidence. The BVA read it and awarded.

It could have been awarded much sooner then that. The AMC in my opinion is just one more stall tactic.

What is the last decision or statement you received from them on your claim?

Hello and thank you for the welcome and help...

To answer the questions;

Have you received anything else from the AMC at all?

No I am just waiting on this mysterious amc '30 day waiver' form, whatever that is...

Did they farm out the claim and order another C & P? Did they issue a SOC or couldnt the person tell you that one is coming.

No originally years ago I had a c&p and my records were lost then found and then denied and I appealed and years went by and the va contacted me with the apology letter and request for a new c&p which I complied with and it went to the rating board at the amc and now they just contacted with the message of signing and faxing this '30 day waiver' to the VBA??? Makes no sense whatsoever and I am figuring that I am denied again I guess, but of course wont know until I actually see it, but having dealt with the us government , military and the va for so long I trust them as far as I can throw them since they are all from the same crooked axis.

Do you have a vet rep?

Yes, I have had the major repvets and I have been very professional and patient with them, but over the years or from moving or if the particular repvet wasnt doing their job have had to change repvets.

It could have been awarded much sooner then that. The AMC in my opinion is just one more stall tactic.

Quote"It could have been awarded much sooner then that. The AMC in my opinion is just one more stall tactic."

That is a very true understatement, I think this whole process was conjured up by uncle sham just to get rid of injured vets that don't continually pursue the miserable va and was developed just to get them to give up. If the va would just look at injured vets records which should show obvious service connection like mine and that I certainly didn't enter military service that way instead if these nonsense bs tactics that they use to get you to quit I think that the process would be a whole hell of a lot of a shorter wait.

What is the last decision or statement you received from them on your claim?

First one was several years ago and was a denial and so now after six months from my last c&p exam that I thought went rather well including positive statements from the docs, I am just waiting on this '30 day waiver' form nonsense, but I am sure that it is another denial of benefits though since that is their goal in life.

Did you get a copy of that C & P exam results? That will give you a leg up for what might be coming.

You have to be very careful about signing a waiver and what rights that you may give up in doing so. If you can scan and post and some of our experts will help you.

No c&p results, don't know how to get that, could ask iris I suppose...

I agree on being careful with the waiver, but why would I have 30 days to sign it and get it back and why a waiver anyway, it just doesn't make any sense, have any of you received anything like this before?
