Need Advise On What To Do

Need some advice, Going to just state the facts with no elaboration from me.Please comment on What I need to do

. Joined army Aug 1972 (17 years old)

5th week of basic MST

Suicide attempt 2 days later

Made to go to Pt Field on second day

Awake for almost 3 days, scared it would happen again.

Went AWOLWent back home and went to my moms house, She showed me a letter she wrote to me that was returned to her,with the words on the flap that said AWOL/Homosexual, (I'm not)

Second attempt on my life, than the minister picked me up and checked me into the Mental Ward 11/29/1972

Minister called recruiter and inquired about what they were going to do.

I was arrested at hospital a week later on Dec 7th and escorted to Ft Riley

Was not treated for any mental conditions, paper work proves it

During the time there I was put in the confinement with the really hard core criminalsI was beaten to a point of unconscious and teeth knocked out

When they gave me a discharge examination ,I only saw the Nurse The form They ask you to fill out about your health ,I stated all the problems I had with the beating,( have copy of it from army file)I was on some kind of drug given to me at the mental ward the entire time

It states on the discharge from the mental ward Personality disorder The file was given to the Mps ,but not in my army file, But I was able to get one from the hospital, 38 years later.

I was taken to a room where my attorney and the officer sat together and with in 10 minutes I was discharged

.I was escort to the front gate and released, with hospital slippers, and no coat,Jan in Kansas, no money ,all stolen in the beating, along with all ID. again 17 years old

What is my case if I have one, I was told back in the early 1970,s when I called the veterans, that I was not a veteran and could not help me.

Seen A VSO and with in 2 minutes said that with a OTH discharge (For the good of the service) did not see a case.

Please help, I want to deal with it before all my life is gone,or too old to enjoy some of it.

You can go online an file but I am not sure what you are going to file for? Depression, PTSD or what? If you were assulated as you say it should be in your records.

Do you currently have a dx for anything? Are you under treatment? If so will your doc say your condition started in the military?

What were you awarded SSDI for in 2002? Is it related to your service condition you want to get comped for?

Usually on sites like this we direct veterans to use a VSO but in your case the VSO you spoke to sounds like they don't believe either you are a veteran or they are not very sure of what to do.

Gives us some more info and we will try and help.

Do you have all your military records? Have you gotten treatment over the years for the MST, depression etc? You might want to try getting a lawyer to look at this case. So much time has gone by it won't be easy, but if you have evidence of suicide and beatings and MST in your records then you can prevail. In that time they kicked anyone with mental problems out on personaility disorder discharge. It happened to me. I overcame it and so can you. The biggest problem is that the military often did not document things in order to protect themselves.

Your quoting a very discouraging BVA decision does not help anyone. No two case are the same. You seem to think that because Landend only served a few weeks that he/she could not have been attacked and that his/her claims are unfounded. How do you know this? I don't think we should sit as judge and jury on a vet who is asking for help. If you can't help, don't hurt. You quote a BVA decision where the conclusion is that the vet "believed" he/she was sexually attacked. How do you know Landend was not attacked. If Landend has any records of suicide attempts even if he/she was only in two weeks there could be service connected factors. Filing after many years is hard. I remember others here whose claims sounded bizzare at first, but as we dug deeper it turned out they were true. Judge not that ye be not judged! I don't think the BVA case you site is similar at all to Landend's case. Did Landend say he/she was victim of sexual abuse as a child? Your statement about having a PD diagnosis meaning Landend has no chance is just crap. I had the worst kind of PD digosis by the military and I overcame it. Half the vets here had PD DX'es at one time or another especially those with PTSD/MST. All kinds of attacks happen in the military and I know someone who was almost murdered over it.

John999, you are right about the big reduction of force during that time. I had 5 years, 8 months, and 23 days in when I was forced out in 1973. It didn't make a damn who you were. I had done 18 months in RVN (the last 7 months as a 67A1F door gunner) and I do believe that I had started to suffer from what we now know as PTSD. Came straight out of Nam and married a girl I had only known a short time. I was sent to Germany for second time and long story short couldn't get with the spit and shine deal anymore and just up and quit. E-5 to E-2 in less than 4 weeks, bam, gone on a Chapter 13.

Still kicking myself in the a$$ for letting one of the best thing in my life slip away. Had the hard part done. But hell, I seen them RIFing out E-6s back then!

Sorry, Landend didn't mean to hijack your thread, If you feel the your are right, fight this with all your will. If things were the way you said they are fight the good fight and prevail over this. YOU did no wrong!
