Question

My wife and I are the legal guardians of and are in the process of adopting our 13 year old granddaughter. Long story short, her father gave up his parental rights in exchange for no child support. Her mother's rights were stripped by the court for drug and child abuse convictions.

Two months ago, my rating was increased to 90%. I still have 2 strong claims in the mill which should give me 100%. Assuming I am lucky enough to attain 100% w/ch 35 benefits, would our then adopted granddaughter be eligible for education benefits? For all she has been through, she is a straight A honor roll student and I will help her in any way I can.

I have number of friends that have adopted Grands & they tell me the Chapter 35 benefits are the primary reason they adopt.

Good Luck,

Don

Yes, she would be eligible. Your "adopted" children ARE your children.

And, bless you for doing so, she certainly never asked for this and you are blessed for helping her (trust me on this, okay, me and G-d have a "direct line" when it comes to this kinda stuff! ).
