100% Perm & Total & Needing To File For Smc

Hello, I am new to this site and am here hope to find help w/my claim as the VA/VBA will not help me. I am aware I can finish filing things myself so that is what I would like to do.

I am out of AF on MEB/TDRL for PTSD, Fibromyalgia, Migraine HA's. combined compensable at 80% but can only draw 75% under title 10 chptr 61 as I have only 7yrs 2mnth `5days of AD service. I also had to waive that as I am unable to draw concurrent receipt unless congress passes laws in Nov 2010. GOD willing. My PTSD is Combat Related and am going through TDRL eval currently and having Migraine HA's and TBI that I have had since 04 but never examined nor identified while in AD after head blow in Iraq 04 granted the combat related honors as well. As this will affect the CRSC that has come out now. I currently have 90% rating w/VA for CRSC.

I am 100% T&P w/SMC (K) for ED and 90% combat related according to VA.

My ED was caused by hypogonadism which caused complete atrophy of the Testies which caused ED but I only recieved SMC(K) even after one of the current 11 condtions I am rated for is complete atrophy of the testies. And CFR states that if ED is caused by Hypogonadism and or Atrophy of Testicles, then SMC (L) should be granted for the ED. How do I fix this?

Also, I am needing to file for A&A, housbound, and possibly other SMC's as I am currently unable to live on my own due to my conditions. I do not yet have any one condition rated at 100%, I currently have 11 conditions granted/rated out of over 60 diagnosed medical conditions. The VA rushed my case, did just enought to get me 100 P&T and called me up, and told me I had maximum benefits and there was no need to continue filing other conditions as I am maxed out at 100% P&T.

I have been issued canes, diabetic shoes for my feet as the atrophy in the feet is so bad now I cannot wear sock without feet feeling like on fire.

I could use some help with paper work, even just form numbers, where to get them as I cannot get them at the VA(will not give them to me, they don't want me to file)

Welcome. Here is a link to VA forms. I think the one you will be most interested in is the form 21-4138, Statement in Support of Claim. Since you already receive compensation from the VA, you can submit a new claim with just this form and any records you want to attach. Just state clearly in the comments that you are submitting a claim for....whatever. Send it to your assigned VA Regional Office, and the VA will then contact you telling you what you need to provide to support the claim.

Do you have a Veterans Service Organization to help you with the claims? The American Legion, DAV, VFW, MOPH, etc. offer free help, and most counties have a veterans service office that could be some help, too.

      I got an email the other day from a Veteran.  It had 2 or 3 sentences about his claim, and then closed at the end: “Please call me. So-and-so told me you were the best and I want your help.”

      While I appreciate the compliments, I shudder a little at emails like this.  For 2 reasons.

      First, I get a lot of emails like this.  And while I diligently represent my clients – I often tell them we will pursue their claim until we have no more appeals or until we win – I am most assuredly not the best.

      There are a LOT of damn good VA Disability attorneys out there.  (Most, if not all, of the best are members of the National Organization of Veterans Advocates…read about one of them, here)

      Second, I don’t want Veterans to choose their attorney based on who their friend thought was the best.  I want Veterans to choose the VA Disability attorney who is BEST for their case.

      In some situations, that may be the Attig Law Firm.

      But it may also be be Hill and Ponton, or Chisholm-Kilpatrick, or Bergman Moore.  Or any one of the dozens of other attorneys who have made the representation of Veterans their professional life’s work.

      There are hundreds of attorneys that are out there representing Veterans, and I’m here to tell you that who is best for your friend’s case may not be the best for your case.

      How do you Find the Best VA Disability Attorney for your Claim?

      First, you have to answer the question: do you NEED an attorney?
