P&t Question

Question

Received increase from 30% to 100 % PTSD about 60 days ago. Thank you Jesus. It has been a long road.

It is not "P&T" but has 2012 schedule for c&P exam. Do I just wait till then to try for P&T or file, if possible. now?

I was found incompetent but fiuciary decided I could hande my finances.

Also, is SSDI a permanent decision or are you reexamined in future?

I am 62 yrs ols.

JOHN1 - it's up to you, on the P&T. You can request it now or wait. The VA policy states that if you are 55yo or older there should be no future exams, so you might want to request it now, especially if you have young or college age children or if your spouse would like to return to college. Also, if the ChampVA insurance would help now would be a good time to file for P&T. Be sure to pickup the life insurance and waiver, now, if you can.

SSDI generally re-examines the file at 2 or 3yrs (I think it's 3yrs) the first time and 7yrs after that, if ever again. I think due to your age they may waive that requirement. They may or may not send you a questionaire. I wouldn't worry about now. You should be free and clear on both. Try to enjoy your retirement and live a long and healthy life, w/the VA paying you as they well should!!! jmo

I agree. Phillip, should he just download and fill out a VA form #21-4138 and simply request that his 100% PTSD be made P&T? Wouldn't that do the trick?

Thanks so much for your info and yes I am 62 and have here at home a 5 year old and an 8 yr and my wife. And yes these are "my" sons "not grandchildren."

If I do apply for the P&T now will Va give me another C&P Exam. It is scary as I don't want to loose what I have finally got. I only applied for PTSD about 3 yeas ago when I got the original 30%.

I was just too ashamed. I know I don't have to explain this. My life since Viet Nam (Special Forces "SOG) has been miserable because of the PTSD.

Congrats on your award John but I want to be honest with you on your question about another C&P. If you file for P&T status it could be required or it could not but if you feel secure on your rating then don't worry about it. If you don't then you may want to just wait until your review is coming up and see how that goes.

Being 62 years old and a review in a couple of years would put you and 64/65 so they may not call you in at all.

Why do you want P/T now? If it is that important to you then just file and see how it goes.

LarryJ - sounds good to me, if VA form #21-4138 is the "Statement in Support of Claim" form. A simple request on that form usually suffices.

JOHN1 - they could request another C&P, if your last C&P is over a year old. However they aren't supposed to submit you to another C&P if you're over 55yo. If the ChampVA insurance would be helpful to your family, you might consider requesting P&T. If not and waiting a few more years would make you more comfortable, go with that. If you're 100%, now, I doubt they'll take it away. It's your call.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
