Question

The Board may appropriately favor the opinion of one competent medical authority over another. See Owens v. Brown, 7 Vet. App. 429, 433 (1995); Wensch v. Principi, 15 Vet. App. 362, 367 (2001).

Is their any way to win my claim after the VA uses Owens V. Brown against me?

correction it was the NP opinion that thrown out because they fell that the DR. has more education.

I understand, 'gousto64'. It can get confusing sometimes.

JMHO... Doctors trump nurses.

Hello I had a case that went to BVA up in DC NP or maybe a Nurse opinion that over a Orthapedic surgeon who said my knee injuries were at least 50% cause of my current bilteral knee problems and the resulting Arteritis. I had a pro bono law firm contact me after it got turned down first time at High Court in DC won to have it remanded for CUE by the nurse that still works at VA hospital in the C/P exam clinic. It is sad to hear others have same problem. Also when your case gets back on Remand like mine is right now it seems like everyone adjustor or what ever titile the people who reviews the claims seems to know more than the real Doctors also. If anyone had their case remanded sure would like to hera from them I am crossing my fingers anbd toes to get my claims done so that I can move overseas this fall I hate the cold. I wish everyone luck adios......

These are older cases; have you kept abreast of any recent COAVC or Fed Cir cases? ~Wings
