  • Can a 100 percent Disabled Veteran Work and Earn an Income?

    employment 2.jpeg

You’ve just been rated 100% disabled by the Veterans Affairs. After the excitement of finally having the rating you deserve wears off, you start asking questions. One of the first questions that you might ask is this: It’s a legitimate question – rare is the Veteran that finds themselves sitting on the couch eating bon-bons … Continue reading

Prostate Cancer Re-Examination

Question

I HAD A RE-EXAMINATION TO CHECK ON MY PROSTATE CANCER IN OCTOBER '09. HAD SEED IMPLANTS IN FEB'08. HAD BEEN MONITORING PSA RESULTS FROM 17.0 JUST AFTER INPLANTS TO OCT.'09 AT .375. VA SENT A LETTER PROPOSING TO LOWER MY TEMPORIAL 100% TO 60% FOR LEAKAGE PROBLEMS, BRINGING ME TO 80% TOTAL. PC-60%/ PTSD-50%/ HEARING-10%/ SMC. I SENT A NOD BECAUSE OF THE C&P EXAMINATION WAS NOT FULL AND COMPLETE. THEY USED BLOOD WORK FROM 6 MONTHS PREVIOUS TO MY EXAMINE. I ALSO WAS ON 100% FROM 2004 OVER FIVE YEARS. ALSO OVER AGE 55. LATER, IN JANUARY 2010, I WAS HOSPITALIZED IN THE VA WITH KIDNEY PROBLEMS AND THE PSA WAS TAKEN AND WAS .250. MY QUESTION IS, CAN THE C&P USE OLD (6 MONTHS) BLOOD WORK? THE PHYSICAL WAS ACTUALLY PUSHING ON MY STOMACH AREA, ASKED IF MY BACK HURT, AND FELT MY ANKLES. A WOMAN PREFORMED THE PHYSICAL, NO ATTENDANT PRESENT, NO FINGER WAVE OR CHECKING ON PRIVATE PARTS. THE ONLY ACTUAL TEST WAS THE PSA OF .375. WHAT DO YOU THINK ARE MY CHANCES OF WINNING THE NOD? ALSO, OF GETTING A FULL & COMPLETE PHYSICAL, OR WAS "THAT" THE FULL & COMPLETE EXAMINE? SINCE MY PSA LEVELS ARE STILL DROPPING, IS THIS CONSIDERED MAXIMUN RECOVERY?

HELLO EVERYONE. CALLED MY REP YESTERDAY, FRIDAY OCT. 22, 2010, TO ASK ABOUT MY VARO HEARING WE HAD SUBMITTED LAST YEAR IN NOV. 2009 AND NO RESPONSE YET. HE WENT UPSTAIRS TO THE PEOPLE WHO HOLD THE HEARING AND ASK ABOUT IT. THEY SCREWED UP AND THAT'S THEIR ANSWER. MY FOLDER HAS BEEN PULLED AND WILL BE CONTACTED SHORTLY ABOUT THE HEARING ACCORDING TO MY REP. PROPOSING TO LOWER MY 100% RATING TO 80% IS QUITE A BIT OF MONEY OVER A YEAR'S TIME. DIDN'T WANT TO WORRY ABOUT THIS THING GOING ON FOR A FEW YEARS AND THE VA ASKING FOR ALL THE MONEY BACK. WANTED SOME RELIEF, AND FINALLY GET AN ANSWER ONE WAY OR ANOTHER. ASKED ABOUT FILING FOR IU AND REP SUGGESTED TO FILL OUT FORM AND PROBABLY SUBMIT IT DURING THE HEARING. I WOULD LIKE TO KNOW IF SUBMITTING THE IU WILL BE A SIGN OF DEFEAT, BEFORE A DECISION IS MADE ON THE PROPOSED REDUCTION, OR IT IS A SMART MOVE TO ENTER IT AT MY HEARING SO IT WILL BE GETTING STARTED? I DIDN'T THINK I COULD APPLY FOR IU AS LONG AS I WAS 100% ALREADY. I ALSO HAVE BEEN APPROVED FOR SSDI OVER 2 1/2 YEARS AGO. PROSTATE RESIDUALS 60%, IF LOWERED, PTSD 50%, TITINTUS 10% WHAT DO YOU THINK OF MY CHANCES FOR APPROVAL OF IU? ALSO HAD 2 KNEE REPLACEMENTS NOT SC. THANKS.

    • Choosing a VA Disability Attorney Means Learning What Questions to Ask
Choosing a VA Disability Attorney Means Learning What Questions to Ask. Chris Attig - Veterans Law Blog

<br style="color:#000000; text-align:start">How to Hire an Attorney For Your VA Claim or Appeal Free Guidebook available on the Veterans Law Blog

I got an email the other day from a Veteran.  It had 2 or 3 sentences about his claim, and then closed at the end: “Please call me. So-and-so told me you were the best and I want your help.”

While I appreciate the compliments, I shudder a little at emails like this.  For 2 reasons.

First, I get a lot of emails like this.  And while I diligently represent my clients – I often tell them we will pursue their claim until we have no more appeals or until we win – I am most assuredly not the best.

There are a LOT of damn good VA Disability attorneys out there.  (Most, if not all, of the best are members of the National Organization of Veterans Advocates…read about one of them, here)

Second, I don’t want Veterans to choose their attorney based on who their friend thought was the best.  I want Veterans to choose the VA Disability attorney who is BEST for their case.

In some situations, that may be the Attig Law Firm.

But it may also be be Hill and Ponton, or Chisholm-Kilpatrick, or Bergman Moore.  Or any one of the dozens of other attorneys who have made the representation of Veterans their professional life’s work.

There are hundreds of attorneys that are out there representing Veterans, and I’m here to tell you that who is best for your friend’s case may not be the best for your case.

How do you Find the Best VA Disability Attorney for your Claim?

First, you have to answer the question: do you NEED an attorney?

      Some of you don’t...
