Another Stellar Example Of Va Rating Policy

Question

I filed a claim for hearing loss and tinnitus in Nov. 2007 at the Houston VARO.

I finally recieved my rating decision in Feb 2009.

Both issues were denied.

I immediately filed a NOD and requested a review by DRO with a local hearing.

It has been 20 months and still waiting for the hearing ro be scheduled.

Oh well, in the mean time I prepared a summary of statements to present at the hearing.

I have attached the document which points out the pertininent facts and regulations.

Please take a look at the summary attached and comment if you like.

You have way too many "may have's" in there that are your own thoughts and opinions.

The Audiologist states "it is as likely as not" - what is the reason the VA denied.

What was stated in the Reasons and Bases Section for the denial of Hearing loss and Tinnitus.

Hi all,

I have taken the time to rewrite this appeal which I want to present at my local hearing if it ever gets scheduled.

I have attached it for others to read and comment

My actual hearing loss is too low for compensation, but should be qualified to get rated approved @ 0%.

The tinnitus should be ok @ 10% rating.

When you go to the DRO Hearing be sure to say "What was that you said? I can't hear you. Stop whispering. Why is everyone whispering all the time?"
