Social Security, Va Disability

Question

I have a few questions here, I was recently approved for Social Security disability and have been requesting and increase of my disability. Can the VA come back and say since you are getting Social Security there is no need to increase your disabilitiy rating . Presently I am 50percent but had to quit my job in September due my disability. Just like info on how the SS plays in the VA roles? I am also collecting unemployment as with SSD they say if you get hired you may have to quit

SSD. My questions are as follows:

1.Since I am requesting my VA to increase the ratings froom 50 to whatever could they come back and say since you get SS we don't need to give you any more money as you are getting it from SS?

2.The SS determined my disability from the VA records. Will this help me in my request to increase my disability?

Yes, I will check with the Dept of Labor on unemployment. My understanding when I read the SSD info is that if I was to get a job then SSD would stop. But I'm with you on that. Fortunately my unemployment will run out just about the same time SS kicks in . 26 week.

I don't think you can collect unemployment benefits when the SS kicks in. This is a No No because on your application you state you will actively look for and accept employment if offered. If you are on SS I think you can't do that.

Thanks Pete53. All medical evidence for SS was from the VA files. It took 1 month for the SS to approve the claim. I was surprised as I would not have even applied but the Voc Rehab counselor stated I should so I did. I applied in October as I quit my job in Sept and the SS approved in November back to the last day of work in Sept. My being unable to work is from my military disability.

Welcome to Hadit. If you can use your medical evidence used to obtain Social Security you should have proof needed to get a rating of 100% in some form or another.

Simply put does any service connected condition prevent you from being able to work.

Much appreciated for your info. I am waiting for the DRO in April. All medical evidence provided to SS was from the VA. Its all military related. Just a sit and wait thing. I have requested the VA provide me with information if any more evidence is needed and what it would be to conclude this. They may or may not reply but they have it all. I was out on disbility twice with the job and grew so bad It something I discussed with the VA nurse and was somewhat agreed on that quiting my job might be the best for my mental condition and boy, she was right. I am glad I have a very supporting wife.

Thank you Berta, I may have to go revise the form now with your input. Sometimes I feel like my VSO should be helping me in this quest. Have you ever heard of getting a second VSO opinion from another organization?

A TDIU claim?

I quess HE doesn't get many approvals.

If you get SSA solely for service connected cpnditins, the VA should award yu TDIU.

Make sure you check Yes to # 18 and then under # 25 Remarks , refer them to separate page with your C file #,name and address on it and tell them of the SSA award, if Voc rehab ever turned you down solely due to your SCs, and tell them of side affects of any SC meds you take that would hinder employability.

SSA determined that in my husbands case too-

initial SSA was for CVA but we filed Reconsideration and the next award with better SSA EED was solely for PTSD.

It took 3 months for the SSA PTSD award and 6 years for the VA to acknowledge the SSA findings.

Make sure the VA gets the SSA records.

Thanks. I kind of thought no would be the answer but wanted to hear it from someone else.

I understand criteria for determining disabilities are not identical, o the SS got all my

info from the VA and soley from the VA so will wait and see. Till April, unless they can tell what evidence is still lacking on my last note to them.

2. Keep in mind that SSA considers all disabling conditions

and VBA only considers disability's that are service related.

I was able to get my SSDI before my VA by using the same record from the VA but the VA still have not giving me my TDIU for my Mental Heath Illness use the same records both say i have the same thing and say it happed the same time onset of the disorder. My question is why is that? I was hospitalitze for it in Feb 1990 for six months to Aug 1990 as inpatient at a VA hospital in Seattle. and 2007 i got my 30% for my ankles but I got my SSDI for my mental heath illnesss back in 1994

How come I have not received my TDIU for my Mental Illness? When two Voc Reb hav both said never (five times ) should I work or try to look for work agian one from the State and the other one from VA
