    Have Questions? Get Answers.

Tips on posting on the forums.

    1. Post a clear title like ‘Need help preparing PTSD claim’ or “VA med center won’t schedule my surgery instead of ‘I have a question.

    2. Knowledgeable people who don’t have time to read all posts may skip yours if your need isn’t clear in the title.
I don’t read all posts every login and will gravitate towards those I have more info on.

    3. Use paragraphs instead of one massive, rambling introduction or story.

Again – You want to make it easy for others to help. If your question is buried in a monster paragraph, there are fewer who will investigate to dig it out.

    Leading too:

exclamation-point.pngPost straightforward questions and then post background information.

    Examples:

    • Question A. I was previously denied for apnea – Should I refile a claim?
      • Adding Background information in your post will help members understand what information you are looking for so they can assist you in finding it.
Rephrase the question: I was diagnosed with apnea in service and received a CPAP machine, but the claim was denied in 2008. Should I refile?

    • Question B. I may have PTSD- how can I be sure?
      • See how the details below give us a better understanding of what you’re claiming.
Rephrase the question: I was involved in a traumatic incident on base in 1974 and have had nightmares ever since, but I did not go to mental health while enlisted. How can I get help?

This gives members a starting point to ask clarifying questions like “Can you post the Reasons for Denial of your claim?”

C-File

RSG

Question

Hi,

another question,

I have over the past year requested a copy of my c-file and nobody from the VA will give me a copy...I have formally requested in writing 4 times and continually get ignored and get excuses from the VA. I think that they are

avoiding giving me a copy because they have done so much illegal stuff with my claim...I need some help getting my C-file. I can't fight these jerks unless I can see how bad they have screwed me.....I need some help with this...TNX, Ron

RSG,

If you have a claim for CUE that is currently under the BVA's

jurisdiction, I would not at this time, request a copy of my C-file for now.

You had posted that you are now 100% SC'd - was this a recent grant at the

BVA level ?

Has an effective date been assigned yet ?

If no effective date has been assigned yet - is your RO supposed to be

adjudicating your effective date for the 100 % rating ?

If your file is at BVA level you don't want to have it pulled out to give you your c-file...follow through with Carlie's info/suggestions if you file has been deciced on already...once back @ your regional level and award is made get a copy of your c-file...just don't stop the process in the middle. plus do you have copies of registered/certified one's where you requested you files?

You request under the FOIA?

Do you use a VSO? If so, did you inform them you never received your records/files?

The asking for a copy is a FOIA and if it is a the BVA it will not be copied until they are done with it. The coping is done at the RO office.

If the veteran is 100% I would wonder why he has an open case unless he is looking for SMC, HB or A&A.

You will not get a full copy of your C-file. To do that you might want to see if your VSO will copy it for you.

I am 100% SMC recently in Oct. 09 but I do have an appeal into the BVA for hearing loss and tinnitus so there are occasions when I vet could still be fighting the VA for an award even though being 100%.

If it were me it all comes down to time and if I need the C-file NOW or can wait until the BVA is done and then the RO is done that to me sounds like years. If you can wait then wait but if you feel like you can not and you have tried the normal channels and FOIA have not be answered. I would contact either my congressman or senator. That is one reason why they are there, if you are not getting what you consider a fair shake by the government. That is where I would get them involved.

The fight you have is one that is only for you since you will not get any more money. you will only hold up other veterans. but if you must keep it up.

Best thing is to relax, stop the fight, and find something to do that you will enjoy. I enjoy helping veterans with their claims. Been doing it for 16 years.

I relax with my photos and fishing.

Yes I could file for 6 other thing that are all a presumptive to my time in service but I do not since I am 100%.

The VSO keeps saying they are six months behind in copying files

But, I have requested it at least 4 times over the past year and a half.....

"will I have to call my congressman od what"

I suggest at this point to contact your Congressman by mail or email and tell him/her how many times you have tried to get the file and that the VA doesn't respond. Their office will probably send you an authorization form to sign-and then they will contact the VA.

I found in the past when I needed my Congressman to look into something-

I sent him just a brief letter and told him specifically what I wanted him to do for me regarding the VA.

I think once he had my authorization form the first time I contacted him, then I didn't need to send it for future problems.

Good thing.

The VAMC refused to admit my husband one day-and he was still on the VA grounds waiting for the Day treatment Van to bring him home. long story-a PTSD situation-

I called Congressman Houghton's office and got his VA liason who knew me by then and minutes later Congressman Houghton called the VAMC director himself and my husband was even paged all over the VAMC and his shrink and the director found him on the van already and they admitted him to the PTSD ward.

I heard from many patients how the director and shrink were running all over the place to find him.

By then Congressman Houghton was aware of another incident in which the VA blatantly had lied to him ,in my husband's regard, and to my two Senators (all documented) in attempt to get me off their backs over another fiasco they committed.

By all means contact your COngress person on this.

Like others have said I would wait until a final decision is made to request C File. However, that does not stop you from going to the VARO and asking to review your C File. I know in Waco I have been able to do that by just showing up but other VARO's may require a request an an appointment.
