Question

V.A. gave me a letter saying they found CUE back in 2002 decision for hearing. They want to check if it got worse since then so they called me with and Audiology appt for next week. Could this mean any change in my 10% compensation? I've lost all hearing in that ear since then. They even gave me hearing aids 5 years ago.

I am hoping I find a jackpot in the form of a CUE going back to 1971 that I found in my C-File. Get hold of your C-File and who knows what you may find especially ancient decisions. The VA was very sloppy during bad, old days. Much worse than now. Many of these old decisions the VA just picked and through the evidence and kept what they liked and excluded the rest. That is the possible basis of a CUE when they don't consider all the evidence.

Thanks-I doubled checked that c-file(whew! -that came in a box the size of my new computer-thanks VA) and found a few more claims that will be filed once this current claim that has been at the rating board since October(my reconsideration-cue claim). The VA folks scribble all kinds of comments on your file-I read all of them. Comments like -Veteran didn't claim Fatigue-that surely will be a good claim rated for secondary to hypertension do to all the medications that do state they cause that issue.
