I get so many claim from veterans whose claims filed under section 3.317 are still coming back with CUE.
When will the RO's get it right?
I had an RO not long ago deny a GWI claim stating that there was no proof that the illness started while the veteran was in the service. I guess the RO needs classes on just what " presumptive to service" is about. They should also read the law again, the court cases that rules on this back in the 90's and the VA guide lines sent out in 1998.
But then again I have some veterans that their RO's are asking them to prove that they have been sick in the service or the one year since they left. They too must not have read the court case in 2002 that stated they could not do this. That the veterans lay statement is all that is needed.
Well I blow off some steam. Back to work.
We all do need to tell the congress to get the RO better trained for that will help in the back log of claim.
