Claim Denied In 2006

Rate this question

RONC

Question

In 2006 I filed for AO prostate cancer. I was in the brown water navy and and was aboard ship. My claim was turned down and stated " no proof of "boots on the ground" denied and "case closed". Since then I have filed a new claim with plenty of proof per the denial. My new claim was filed Nov. 2010. My question is if approved do they retro pay me back to 2006 or pay me back to the new clam(2010?). Thank you. I did nothing when denied in 2006 until I filed new claim in 2010. Still retro back to 2006? Thanks.

I would agree with the rest you will and should be paid back to the 2006 date. I would file to reopen that claim and send them the info for your boots on ground.

Your present condition of your PC will come into play as to how you are rated in the past and present.

If you had the surgery I am assuming you did not use the VA but private docs? I hope you have all those records and the continues care so the VA can not low ball you!

I wish you luck on your claim and wonder why it has not been awarded? how long ago did you file?

RONC,

What did you submit in 2010 to prove boots on ground ?

I found the deck logs that had my ship docked at danang pier and liberty call. Also I sent in two excellent buddy letters, medical records etc. On my PC claim in 2006 I was denied for "no boots on ground' and filed a new claim in 2010 with proof. Wonder ifre my retro will only pay back to the 2010 claim? I have gotten several different answers on this. Thanks, Ron.

Also, I failed to mention that I have had a Pc recurrence in 2006. Thanks, Ron

The Nehmer Training Guide in our AO forum will have a definitive answer to this question.

If someone here has questioned the 2006 retro date I agreed you should get -ask them to show us their support for that in the Nehmer Training Guide.

Danang -anchoring in the harbor wont do it.

"my ship docked at danang pier and liberty call." Yippee that should do it!!!!!!!!!!!!!!!!!!

Ron, what ship was you on. They added some ships on the BLN site that did dock at thepier in Danang.

I feel that you should get paid back to the original date. Dont give up on this.
