Claim Denied In 2006

In 2006 I filed for AO prostate cancer. I was in the brown water navy and and was aboard ship. My claim was turned down and stated " no proof of "boots on the ground" denied and "case closed". Since then I have filed a new claim with plenty of proof per the denial. My new claim was filed Nov. 2010. My question is if approved do they retro pay me back to 2006 or pay me back to the new clam(2010?). Thank you. I did nothing when denied in 2006 until I filed new claim in 2010. Still retro back to 2006? Thanks.

Berta, I once again sent a note to NVLSP and here is their reply...Dear Mr. XXXXX,

The Va first published the regulation which established prostate cancer as presumptively service-connected due to Agent Orang4e exposure on Nov. 7, 1996. As noted in our e mail of Dec. 9, 2010, to you, it does not appear that your case falls within the guidlines under the Nehmer court order because your claim for prostate cancer was originally filed after the V A added prostate cancer to its list of presumptively service connected diseases. I hope this information is of assistance.

Prostate cancer added 1996 and I was dianosed on 2001. Claim filled in 2006 and denied. New claim 2010. What am I missing here? Thanks, Ron.

I assume neither a compensable rating was an issue and I assume your incountry Vietnam service was not an issue- so

I don't understand their response at all.
