You always want to file with the RO a "Notice of Intent to file a Writ of Mandamus" before you file a writ. The reason is you give the RO one last chance to fix the problem. The CAVC likes that. A Writ is a last resort, after you have tried everything else.

But, even tho your writ will likely be denied, it still get the RO moving on your claim, usually. I agree with Allan that if your claim has not moved in 16 months, then file a writ..after the Notice of Intent to file a Writ.

I would add that if it gets down to you having to file a writ in order to get your claim moving from a lengthy delay, say 14 to 16 months. Than you must notify them in writing, that you "will" be filing a writ in 30 days. The written warning is sometimes enough. If not, file that writ.

My husbands claim is at the AMC.

Do I still file the intent with the RO or with the AMC ?

This is on a claim the BVA granted then sent back to RO for rating.

RO sent it right over to AMC in May 10'.

It's been over a year since BVA granted.

vetwife,

If BVA has granted an issue/s and it's upto your VARO to adjudicate

percentage evaluation and effective dates -

I would check through fanaticbooks section here on Fast Letters and

printout the one regarding claims granted at BVA are to be adjudicated

for payment to the claimant before any more work is done on the claimants remaining issues.

Tell them to pay what you should be in receipt of now.

i have a remand iu claim from 1994-2001 and say on it that the veteran is now services connect for elbow and this should be look at with my neck issue.

they have closed out my elbow claim. and no one will look at what they done.

so dont no how to started it but i believe there are more than enough veterans on here who claim are been done wrong by the amc.

lets join together to closes this place. or put it in the light.
