Nod & De Novo Review Filing Timeframe

Question

I have read were you have 60 Days to file a De Novo Review ??????????

I have read its the same as a NOD you have 1 year to file a De Novo Review or a NOD they are the same you just ask for a (De Novo Review) at the bottom of your NOD??????????

Anyone know the Facts?????

You have 1 year to file a NOD from the date stamp on your SOC. At the time you file the NOD you have the option to request a De Novo Review (DRO review) or you can request a DRO hearing. Once you file the NOD though you can request a DRO hearing at any time during the waiting period. I have always advocated that vets request a hearing, I have won everything I was asking for at hearings. The hearing is informal and allows you the opportunity to answer any questions that the DRO officer has, it also allows you to present documents and speak for yourself.

Thanks for the info, i am waiting for my De Novo Review its been 8 months im hoping i will get re rated properly but i did state in the De Novo Review i would try it first before filing a regular NOD and hearing. I would assume it would make them look bad if a senior rater rates me low and then i appeal and it gets rated higher.

I have 5 or six other claims to put in should i do them all at once or a couple at a time? after my re rating comes back!??

I've never heard of even having a De Novo Review without filing a NOD first.

No, it won't make them look bad.

Carlie passed away in November 2015 she is missed.
