"Grants of Service Connection under the Provisions of 38 CFR § 3.313

Under the provisions of 38 CFR § 3.313, Veterans who served in Vietnam, including

service in the waters offshore, are entitled to a presumption of service connection for

non-Hodgkin’s lymphoma.

We have received questions about the connection between non-Hodgkin’s lymphoma,

chronic lymphocytic leukemia, and small-cell lymphocytic lymphoma. Discussions with

medical professionals at the Veterans Health Administration (VHA) and with our

attorneys at the Office of General Counsel (OGC) led to the conclusion that these

diseases should all be considered the same disease for purposes of § 3.313. We will

update the manual to reflect this determination."

I am bumping this up and adding a BVA link, because we had a CLL-M Agent Orange  veteran's spouse here recently----

I dont think she has returned yet....a new member

The BVA case is in that link and might help her

I hope this can help a Mr. Garton presently at CAVC (Docket 10-2744)

as he was denied due to not having NHL but has CLL.(Blue Water vet)

An attorney recently filed as his representative at CAVC and hopefully she can get a joint remand out of the CAVC to open his case up again for new evidence (which would be this new C & P Memo)

I understand John Rossie and Blue Water Navy pushed for this addendum to the AO NHL regs and this is great news for any Blue Water vet similarly situated.
