Effective Date For Tdiu

In April 2009 I was increased from 0% SC for major depression to 50% & 30% SC for migarines. Did not know about TDIU until 6 months later and than filed proper form through DAV office. I met qualifications since I had not worked full time since Feb 06 and gradually part time work became pointless after losing 7 jobs in 30 months. (not my proudest moment). While I've been waiting for a decision on TDIU I received other SC ratings. 40% for Chronic Fatigue (actually, probably should be Fibromyalga but it's similiar) and 10% hypertension. MY TDIU is just being considered for increase for the 1st two conditions I listed and I have a lot of medical records to support those conditions worsening. C&P exams for the headaches & depression both state that these SC conditions have greatly affected my ability to work and all aspects of my life. ...i'm rambling..blah.blah.blah..sorry.

I would like opinion on possible effective date IF i am rewared IU.

The award for TDIU should be the date you filed for it. Sometimes you can get an earlier date based on hospitalization or SSD award. Did the VA know you were not working or only working part time in 2006? There is such a thing as an inferred TDIU claim. If you could not work due solely to SC conditions and the VA knew this they should have inferred TDIU. That you will have to fight for later probably. I filed for TDIU when I was 30% and they went back to that date when I got 70%.

I will look at my copies of the C&P exams from my first claim for the increase. I do believe there was a statement from the examiner about my employer "no longer requiring my services" ( I was an Independant Contractor working as a firearms instructor for BlackwaterUSA). My last day of work was the day I told my supervisor that I was perscribed Buprion for anxiety. All Hell broke loose. It bothered me for a long time how quickly I went from a good employee to a piece of garbage. Co-workers that I considered friends avoided after I was let go. The Air Force had basically done the same thing after serving over 12 years with a spotless record. They medically seperated me for not being able to "adjust" after a personal traumatic incident. My Commander & First Sgt both wrote letters staing that a temporary retirement to allow me to get treatment would benefit both me and the military but the board didn't consider it. I was given 10% and severance pay. VA also "generously":dry: gave me 10% for about 6 months than quickly took it away when I didn't show for a appt. that I didn't know about because I never thought to update my mailing address with them. I would have retired last week if I had been able to complete my career like I had planned.

Here I go again with the long stories. Husband & boys have been on vacation now for almost 2 weeks and the quiet house is making me batty (and lonely).

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
