Eben Shows A Claim As Closed And Admin Review

I have a claim that has the same info and shows as closed and open with a status of administrative review. Anyone else out there had this happen??

Yea!! it happened to me. I checked eben last week and my claim had been closed in Dec. and appeal in Feb. and in Development phase in late Feb. I called the 800# about 40 times before I got thru and they told me it is pending appeal.

Update: I noticed on eBenefits today that one of my claims went from Development to Closed. When I opened the claim remaining in development (since 6/2010), the condition which I recently claimed was listed with the older claim. Both are claims secondary to current SC treatments (medications). ????? Anyone had this happen? Are they actually giving me an earlier claim date?

None of them make any sense because there is little conformity

in adjudication.

Carlie passed away in November 2015 she is missed.

I agree. It's so dmn frustrating. It looks as though they've lumped all secondary claims into one clam, and have added another issue. BTW: I've had another service officer look at my file (as far as they can without being my POA VSO) and he said that I've requested no other claims be processed or my appeals moved until one particular claim was decided. I don't even know what he's talking about. I can't find any email from my current VSO explaining this. She just gets snippy whenever I ask her how it's going...

He did, however, provide the current codes and exact status of what he could see. He provided the most comprehensive review of claims and appeals I've ever had via email, and did it quickly. I'm really impressed and ready to sign a POA to transfer from the DAV to the GA State rep. (Sorry - off topic...)

Update: Now, eBenefits shows THREE claims filed in the same claim date. Does anyone know if this means they're just stacking them up in one 'easy kill', or if they would do this to keep them with one rater? I'm so confused and ticked off at the same time. Tired of the waiting game today, so it really doesn't help to see inconsistent information. Again, would this mean that they actually giving me an earlier effective date?

It's really hard to say, ebenefits is not fully reliable yet to actually count on the information you find there.

I would recommend you send an IRIS, or maybe the awful, dreaded 800#, and ask why the dates are now all the same. There may be an explanation, but now way anyone here will know why until they tell you and then you tell us.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
