C & P Exam

I found this board a couple of weeks ago and have been reading posts and learning. I would not have known I could get a copy of my C & P if not for this board, so thanks to everyone. I was in service in 1971 & 72. I was discharged for anxiety and panic attacks. I started soc. sec. for this about 5 years ago. My question is I just got a copy of my C & P today and it says "I do not believe his psychiatric disability pre-existed his military service. It is as least as likely as not that it is related to an incident or incidents of service.

Is this good.

Welcome to Hadit. I am service connected for Panic Disorder and was awarded SSD for panic in 1991. Because the attacks were documented in my Service Medical Records I eventually got service connection at 100% P&T.

A good medical opinion that opines that you had panic disorder while you served should do the trick.

I was medically discharged for this, but denied disability in 1975 because they tried to say it was pre-existing. Never had C & P until now, because in 1975 when they set me up for an evaluation I panicked and didn't go.

The opinion you got was a good one but I am concerned about the 1975 decision. You may possibly have a CUE claim from 75. Do you still have that decision?

It wont be easy but you may be entitled to a crapload of retro, Are you an in country RVN vet?

I just didn't go for the c & p in 1975. They said because I didn't show up I was denied and they said they sent me a denial letter, but I don't remember getting one and there was no other correspondance from them. When I was in Washington DC for my BVA hearing my lawyer addressed that to the judge and said we would pursue this after a decision was made on my case.

Yes get a decision first and than go for CUE. Looks like you have a good lawyer.

shwebb my c&p exam letter sounded a lot like yours. It said at least as likely.I was discharged from the army and hospital the same day for personality disorder. I don't have a personality disorder. They used that to get rid of me quick. I have panic disorder, agoraphobia and bipolar 1 disorder. We filed the claim on panic disorder. I was denied. Then filed a NOD had a c&p and was approved at 100% P&T. I got the letter 4 months after the c&p. I got out of the army in 1983 but never knew I could file a claim until my doctor told me 2 yrs ago. I had a hard time getting my medical records from St.Louis. They finally sent part of them to my doctor and then I got the rest from the RO during the claim process. I found out I was also diagnosed with ajustment disorder and given anti depressents and mood stablizers. Anyway I think your c&p sounds good.
