C & P Exam

Question

I found this board a couple of weeks ago and have been reading posts and learning. I would not have known I could get a copy of my C & P if not for this board, so thanks to everyone. I was in service in 1971 & 72. I was discharged for anxiety and panic attacks. I started soc. sec. for this about 5 years ago. My question is I just got a copy of my C & P today and it says "I do not believe his psychiatric disability pre-existed his military service. It is as least as likely as not that it is related to an incident or incidents of service.

Is this good.

To answer you original question concerning your C & P:

The examining doctor was applying his opinion as to the etiology of the condition and believes it to be service connected in some unspecified way.

I don't know how much weight it carries as he does not back up his opinion with any facts from any service documents.

The C & P exam doesn't make much sense to me at this point.

shwebb my c&p exam letter sounded a lot like yours. It said at least as likely.I was discharged from the army and hospital the same day for personality disorder. I don't have a personality disorder. They used that to get rid of me quick. I have panic disorder, agoraphobia and bipolar 1 disorder. We filed the claim on panic disorder. I was denied. Then filed a NOD had a c&p and was approved at 100% P&T. I got the letter 4 months after the c&p. I got out of the army in 1983 but never knew I could file a claim until my doctor told me 2 yrs ago. I had a hard time getting my medical records from St.Louis. They finally sent part of them to my doctor and then I got the rest from the RO during the claim process. I found out I was also diagnosed with ajustment disorder and given anti depressents and mood stablizers. Anyway I think your c&p sounds good.

please clarify something for me, did you have a c&p on the original panic disorder claim? if so, was there a nexus? please correct me if wrong but wasn't your nexus statement that it was at least as likely as not from your current c&p exam?

No I did not go to the c & p in 1975 because of my mental state at the time and was denied because I didn't go to the c & p. I spent the next 35 yrs in treatment by private and VA doctors and did not pursue disability again until 2007. In 2007 I was considered by soc. sec. as disabled for general anxiety and panic attacks. When that happened I decided to pursue Veterans disability. On my current c & p the doctor starts off saying " after reading letters from his wife and brother as well as history written by him as well as psychotherapy progress notes and his c-file I do not belive his psychiatric disability pre-existed his military. It is as least likely as not that it is related to an incident or incidents of service. I had also previously submitted buddy statments from 2 friends who knew me before and after service and who are still friends.

Thanks for the update. At this point you have done all you were supposed to do to help your claim.

I guess just wait for a decision and see what they decide.
