Tsgli Changes October 1, 2011

I may have already posted this here, or seen it posted here, but I looked and could not find it so I wanted to make sure it was known.

10/1/2011 They are changing the requirements for Service Members, or Veterans who were seriously injured due to a traumatic event. From 2011 until 12/2005 if you were injured and qualified for the TSGLI payment anywhere from $25,000-$100,000 depending on your loss, you had to have suffered the injury in the OIF/OEF Theatre. After that it could be anywhere in the world as long as you had SGLI, and for those who did not have SGLI, if they were injured in theatre then they would be eligible anyway.

I knew nothing about TSGLI until after I retired but was reading some legislation one day and saw it mentioned. I didn't fully understand the guidelines so I went to the VA website and checked out the SGLI site. I suffered a traumatic event on 5/27/2005, but I did not suffer a loss of 30 days of daily living activity until 2/2006, therefore I did not qualify. October 1st of this year they are changing the guidelines making service members who suffered a traumatic event anywhere in the world, who were covered by SGLI, eligible to receive TSGLI.

I already contacted NAVSTA Millington, TN and verified that they are sending my claim in for payment on October 1st. I had applied last year because I was a little confused by the explanation, but was denied. I also knew at the time there was legislation pending to change it so I would be eligible this year.

For anyone who suffered a traumatic event while serving after 9/2001, and who has not received, was denied, or ever applied for TSGLI, I would recommend you chack out the information on the VA website. I might be a little off on the dates, but they should be pretty close. For any of you who don't qualify, I can't apologize for Congress, they make the rules.

Cooter, typically Congress makes legislation effective a year or more in advance to give the agency's affected time to implement it, including budgeting for it. This one is no different.

Actually, I meant earlier than 2001 effective date. I should of explained in more detail. Sorry about that.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
