Family Caregiver Program For Injured Vets. UPI Veterans "may be eligible for a family caregiver program if they are medically discharged for a serious injury, officials say. Dr. Robert Petzel, Department of Veterans Affairs under secretary for health, says US law, for the first time, provides a direct benefit to designated, approved family caregivers of eligible post-Sept. 11, 2001, veterans, including monthly stipends and health insurance." The article notes that almost 1,650 applications had been received as of July 26, and 567 stipends averaging $1,600 monthly had been approved.

This is nice for a start, but there are about 200,000 100% disabled vets who need help.

I think that question has already been answered. After 2 years of the pilot program there will be a recommendation to extend it to all Veterans who are eligible, or shut it down. Since they are hyping it up so much I would guess they will extend it to all Veterans May, 2013.

Do you think with these budget problems the government is going to extend this expensive benefit to thousands more vets? You are more optimistic than I am.

I know that in the long run the VA will save money with this program. After all they are on the hook for the expensive care if the family won't do it.

USNDW:

Thanks for your info it makes me feel like we have a shot at this program.

Veterans deserve real choice for their health care.

I may be optimistic, or pessimistic. Like I said, they are going to expand it or reduce it. I don't think they will get away with not expanding it, like you said there are over 200,000 Veterans who might qualify. I have to wonder if they are going to try and make some regulations like, people on Social Security, or at the age to draw SS will not qualify?

I don't know what they intend to do, but I do hope it is something very unlike the Post 9/11 GI Bill. That is why Senator McCain did not vote for it, because it excluded most Veterans, offering better benefits to others because of their time of service. Like you, I don't think the VA should be selecting a range of Veterans who qualify for this and others don't because the dates of service, but pilot programs have to be given a chance to work, or fail.

If the budget cuts will limit the # of Veterans for the Caregiver, then I think they will have to eliminate it all together.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
