Question

Received a decision today on IHD and Agent Orange. I have a questing on how they figured the retro.

They stated my LVL in 2000 was at 48%. There decision awarded me 10%. Should this have been 60% based on LVL @ 48%

Then they stated I had a C&P in September 2008 that showed a MET of 10. Which I sent in a NOD.

Then had another C&P in October 2009 that showed a MET of 11. Which I again filed a NOD. As it was a NP that only ask question and did not testing.

Then had another C&P in Janurary 2011 that show 3-5 MET and LVL @ 50% / Decision awarded 100% starting Janurary 2011.

Seem the retro should be based on 60% from the year 2000 thru 2008. As I think it will be hard to fight the years 2009 & 2010 as I don't have any outside medicail documents. Was being treated by the VA.

How do the establish the MET and LVL on your heart by just asking question? What is the law on testing and where can I find documents on what testing is required to CUE the METs the PA stated in 2009 & 2010

More than one episode of acute congestive heart failure in the past year, or; workload of greater than 3 METs but not greater than 5 METs results in dyspnea, fatigue, angina, dizziness, or syncope, or; left ventricular dysfunction with an ejection fraction of 30 to 50 percent 60

If the regs are the same in 2000 as they are now, then you have a definate mis application of the rating schedule.Lay it on them.
