The VA rates this according to range of motion or incapacitating episodes (prescribed bedrest/treatment), whichever warrants the higher rating.

Keep in mind, incapacitating episodes must be documented with your doctor to be considered.

If the C&P examiner didn't use a Goniometer to measure the Range of Motion, then the C&P exam was technically inadiquate for rating purposes! You can certainly let VA know this, but the problem is tying to actually prove it. It's his word against yours!

You could appeal the decision on that bases, and normally, through a DRO review, the DRO would schedule you another exam. Hopefully this would be with another examiner! By doing this way you would perserve your original effective date.

You could also just apply for an increase, which would trigger a new C&P exam. However, you would loose the original effective date if an increase is warranted. Your increase would be effective the date you requested that increase.

Jessie, The Range of motion is listed int he 38 cfr part 4 also. Also be advised that if you have any nerve damage, then it is to be rated separately.
