    • The 5, 10, 20 year rules...



      Five Year Rule) If you have had the same rating for five or more years, the VA cannot reduce your rating unless your condition has improved on a sustained basis. All the medical evidence, not just the reexamination report, must support the conclusion that your improvement is more than temporary.



      Ten Year Rule) The 10 year rule is after 10 years, the service connection is protected from being dropped.



      Twenty Year Rule) If your disability has been continuously rated at or above a certain rating level for 20 or more years, the VA cannot reduce your rating unless it finds the rating was based on fraud. This is a very high standard and it's unlikely the rating would get reduced.



      If you are 100% for 20 years (Either 100% schedular or 100% TDIU - Total Disability based on Individual Unemployability or IU), you are automatically Permanent & Total (P&T). And, that after 20 years the total disability (100% or IU) is protected from reduction for the remainder of the person's life. "M-21-1-IX.ii.2.1.j. When a P&T Disability Exists"



      At 55, P&T (Permanent & Total) or a few other reasons the VBA will not initiate a review. Here is the graphic below for that. However if the Veteran files a new compensation claim or files for an increase, then it is YOU that initiated to possible review.



      NOTE: Until a percentage is in place for 10 years, the service connection can be removed. After that, the service connection is protected.



      ------



      Example for 2020 using the same disability rating



      1998 - Initially Service Connected @ 10%



      RESULT: Service Connection Protected in 2008



      RESULT: 10% Protected from reduction in 2018 (20 years)



      2020 - Service Connection Increased @ 30%



      RESULT: 30% is Protected from reduction in 2040 (20 years)

      All VA Claims questions should be posted on our forums. Read the forums without registering, to post you must register it’s free. Register for a free account.

      Tips on posting on the forums.

      Post a clear title like ‘Need help preparing PTSD claim’ or “VA med center won’t schedule my surgery” instead of ‘I have a question’.


      Knowledgable people who don’t have time to read all posts may skip yours if your need isn’t clear in the title. I don’t read all posts every login and will gravitate towards those I have more info on.


      Use paragraphs instead of one huge, rambling introduction or story. Again – You want to make it easy for others to help. If your question is buried in a monster paragraph there are fewer who will investigate to dig it out.


      Leading to:

      Post clear questions and then give background info on them.

      Examples:

      A. I was previously denied for apnea – Should I refile a claim?


      I was diagnosed with apnea in service and received a CPAP machine but claim was denied in 2008. Should I refile?



      B. I may have PTSD- how can I be sure?

      I was involved in traumatic incident on base in 1974 and have had nightmares ever since, but I did not go to mental health while enlisted. How can I get help?



      This gives members a starting point to ask clarifying questions like “Can you post the Reasons for Denial from your claim?” etc.

      Note:

      Your firsts posts on the board may be delayed before they show up, as they are reviewed, this process does not take long and the review requirement will be removed usually by the 6th post, though we reserve the right to keep anyone on moderator preview.

      This process allows us to remove spam and other junk posts before they hit the board. We want to keep the focus on VA Claims and this helps us do that.

Outreach to Homeless Shelters and Service Providers:

In November 2009, VA developed a 5-year plan to end homelessness among

veterans by assisting every eligible homeless veteran willing to accept

service. VBA generally defines homeless as lacking a fixed, regular, and

adequate nighttime residence. VBA provided guidance to all VAROs that

claims submitted by homeless veterans should receive priority processing.

At the time of our inspection, VBA determined its national performance

measure for processing homeless veterans’ claims based on the average days

the claims were pending. VBA’s national target was for the claims to be

pending no more than an average of 75 days.

Seven (23 percent) of 30 homeless veterans’ claims pending at the time of

our inspection had processing delays. The seven delayed claims had been

pending from 29 to 124 days. However, as of September 30, 2011, homeless

veterans’ claims at the St. Petersburg VARO were pending an average of

66 days, 9 days less than the national target. Therefore, we made no

recommendation for improvement in this area.

Congress mandated that at least one full-time employee oversee and

coordinate homeless veterans programs at each of the 20 VAROs that VA

determined to have the largest veteran populations. VBA guidance, last

updated in September 2002, directed that the coordinators at the remaining

37 VAROs be familiar with requirements for improving the effectiveness of

VARO outreach to homeless veterans. These requirements include

developing and updating a directory of local homeless shelters and service

providers. Additionally, the coordinators should attend regular meetings

with local homeless service providers, community governments, and

advocacy groups to provide information on VA benefits and services.

Lip service.

Many homeless vets are on the move with unreliable mail, won't receive notice of C&P's and or when additional evidence/action is needed.

General Delivery mail at post office is unreliable (I usually was handed other people's mail as well and made sure to give it back; not everyone does).

Their claims will be denied and the cycle continues.

VA needs more aggressive action to help homeless vets. This is all show.

Good luck to ya brother. Having that attorney is good; I hope all mail is directed to them.

Cooter, I agree with you, however, I don't want to be in a shelter, I don't drink or do drugs, I was denied SC

PTSD by the VA 16 years ago, I haven't worked in 7 months, due to other ailments as well, I just want them to make a decision, whether it goes my way or not.

When I filed for the homeless expedite, I got a call a month later from the local VA homeless coordinator, thinking something positive would maybe come out of it, but she said right off the bat, before I said a word, "You need to send in your signature for a NSC pension" I said forget it then, and then the only other thing she asked is, "Are you still homeless?" I said yes, and then she said "Send me an email to say you don't want to do the NSC pension" and that was it.

Every time I speak to this person, she is very "brusque" and is no help.

Notorious Kelly, thanks for for the kind words.

My attorney, although he has helped in some ways, was really for the situation if I get denied for the PTSD once again.

I don't think he can do anymore than any VSO can do at this point, but if nothing good comes out of this current claim,

he is much more capable than any VSO for whatever I choose do to afterwards. Oh, and yes, he gets everything that I

get as well, I made that very clear to the VARO.
