I HAVE A QUESTION FOR THE FORUM.

CAN AN "EFFECTIVE DATE" CLAIM PENDING BEFORE THE BVA BE RE - DACTED BY THE BVA AND SENT BACK TO THE LOCAL VARO AND THEN BE PAID THE RETRO??

HAS ANY VETERAN EVER HEARD OF THIS ACTION OR HAD THIS HAPPEN TO THEM?

IT'S CALLED RE DACTING A PENDING BVA CLAIM? JUST CURIOUS IF THIS IS TRUE OR JUST HERE SAY?

Are you sure you don't mean remand back to the regional office... never heard of the any claim being redacted......

SORRY FOR THE LONG QUESTION I HAVE BEEN SICK FOR LONG TIME AND TAKE A BUNCH OF DIFFERENT MEDS I LIKE THIS WEB SITE BECAUSE IT GIVES ME HOPE!!!

I don't know of any such actions, I don't even know if it would be possible since once a claim is denied it is appealed by the veteran to the BVA. Wouldn't seem logical for the regional office to pull it back. I think once it is appealed , the BVA must take some action, or the veteran can withdraw the claim...

I would think it would be possible, for the RO, to recall a case, especially because, I believe, the c-file is held at the RO until about 90 days before the BVA is actually going to review the claim. I don't know of any cases where it's happened, tho. It would essentually be the RO calling a CUE on itself and the evidence would need to be quite compelling. I think redacting is the wrong term, as it's where they block either personal identifying info or other confedential info. jmo

Maybe possible- but I think the word he means is Remand.......and we get notification from BVA when a claim is remanded back to the RO.

If this regards an actual claim, maybe the ombudsman could help you find out where the claim is.

I need to see if the BVA site is still down and email the ombudsman if it is.

They were glad I did that ,the last time the decision part of the site was down for quite a few days.
