BEEN 3 YEARS NOW CAN YOU SHOW OR ADVISE ME SHOULD I DO A WRIT OF MANDAMUS??

OR JUST CONTINUE TO WAIT THE VA OUT? SPRING SUMMER WINTER GOES BY YEAR AFTER YEAR NOTHING NO DOCKET NUMBER NO LETTERS NOTHING??

IM WORRIED I MIGHT DIE BEFORE I EVER GET A HEARING AT THE BVA

I'M GETTING TIRED OF WAITING.

grent, I agree with carlie. I also have a claim at the BVA since April 2010, but I got a DOCKET number in a short time after they received the claim. If you have a Veterans Service Officer (VSO) or State Rep, call them. If not, you can call the Ombudsman in Washington at 202-632-4623 from 9:00 to 4:30 Mon thru Fri. Their web site is: www.vba.va.gov/index.asp

the lawyers told me they wrote a brief so im sure their must be a dockett number ill BVA see what i can find out.

"but i don't bother calling they the lawyers dont like you bothering them besides their never in their offices always gone ." And they do not like you to contact the VA directlyu to find out status but they can never find the time themselves...

You need to get to the bottom of this.

First, contact your attorney, making it crystal clear you expect a prompt return of your phone call or you will consider "firing" your attorney..that you have been unable to speak to them, and you need to speak to someone or else..you plan on changing representation. Tell the attorney's office that 3 years is too long and you plan on filing a writ of mandamus...with or without your attorneys help.

If the attorney's office does not contact you in a week, then follow up and fire that attorney. Jim Strickland should also know the service an attorney he recommends is giving.

Next, contact the BVA ombudsman, and inquire as to the status of your appeal. You can also do this with ebenefits, but dont "take to the bank" what ebenefits says.

Tell the next attorney/VA rep you expect at least an annual update as to the status of your claim if they are unwilling to do that, then look for another representative or consider flying solo.

The VA gets away with 3 or more year delays because they can. Inform them (attorneys, VA reps, etc) that this is unacceptable, and that you will take the neccessary action to get things moving, including but not limited to a complaint with the "Bar".

Then follow up, never make threats without intent of backing them up with action.

You can/should also follow up with IRIS, ask the status and do not "settle" for a "general" answer....such as "the Va is very backlogged and are working on your claim...blah, blah..."

Tell them you need to know why the BVA has taken your claim "out" of docket number order as the BVA is required to do them in docket number order except in hardship cases. Tell them you want to know when your claim was "docketed".
