C&p How Do I Get A Copy

Question

I had my C&P and Hearing exam back in Dec 2011 how long before I can see the doctors reports,and how can I get them if their isv a chance. I have not heard anything , my exam was done in St.Pete, Florida.

Hello Sapper..... I am sorry but I do not know where your C and P was done. Was it QTC or a VA clinic or Hospital? I am going to take a stab at it that because you have gotten a copy of it , it probably was done at a VA clinic and NOT QTC , because of how fast you said you go it.

What this all means is that a rating specialist at the Regional Office must look at this report and try ,,,TRY to give you a fair,,,,FAIR rating . In my opinion no matter what the VA rater does it will almost always be a lowball to the Veteran , therefore it will be a faulty one and incorrect , probably leaving you to NOD or Appeals process. Have you received an award letter or a denial letter AFTER this exam date?

I got the C&P report from the VA hospital at the ROI. I walked in and Got it released to me. The only letter I have gotten was two stating they are working on it. (No award or denial letter) I dont know how long it will take, hope soon. Do I still need a IMO or what the VA doctor stated be all that I need.

You may need an IMO if you think - -

The C&P minimized your medical condition.

The C&P was not complete in addressing all the "issues" contained in your claim.

You believe the C&P is not accurate, or contains false information.

Sounds like you'll probably get something out of it. Tinnitus is only 10% max, and the other disabilities

depends how bad they are.

For the back and ankle is that based on ROM alone or can pain on ROM be also a factor.

For my back I do have ROM of 70 foward flexion,50 painful motion begins,25 extension ends,15 extension painful motion begins,30 lateral ends,20 lateral evidence of pain begins, 30 lateral ends,20 lateral flexation evidence of pain begins,30 right lateral rotation ends,20 lateral evidence of pain begins.For the post-test forward flexion ends 70, post-test extension ends 25,right lateral flexion ends 30,left flexion ends 30, right lateral rotation ends 30,left lateral rotation ends 30 .

For the ankle ROM is planter flexion end 40,planter pain begins 30,dorsiflexion 15,dorsiflexion pain begins 10,post-test plantar ends 40, post-test dorsiflexion 15.

Hello Sapper,,, THAT IS GREAT. You were able to get a VA C and P so you got your copy. Now as far as them rating it , I would not do anything until you get a DECISION............in writing from them . Good or Bad. After that is when the bear hunt begins. You may then get an IMO to add to your NOD or Appeal . That is when you fire your BIG Gun with more evidence and IMO . You have to find out first what did they rule on and make a decision on and if it is a denial ,what are your rights and the next step in the process. The decision will specifically point out anything that was noticed or could also not even address an issue CORRECTLY. This is the time that will be most imporatant.

It appears the VA ........as Jbasser puts it .......is about ready to give you a cookie. That will open the door alittle. Your ROM figures may be looked at in the 38 CFRs and the M21 rating schedulars so they will be adjusted to fall into those parameters for rating.

Your tinnitus is just as cooter reflected .... 10%. You may also have a Hearing loss and though it may yield an initial 0% Service Connection it could be brought up to 10 and in some extreme cases to 20% if handled properly in the appeal process.

Your main goal is to WAIT patiently for the decision letter and hopefully ....from what you have posted it appears you will be awarded something. Then will come the appeal process and your Bear hunt begins.

Second but even more important than anything else is.............NEVER GIVE UP. God Bless, C.C
