If you believe you have a good claim get another lawyer. Why did your lawyer drop you?

Keep in mind that even lawyers (legal representatives)

have specific regulation and laws they must adhere to.

Your claim can't be certified to BVA and your representative

just simply DROP you.

If you get to CAVC, which I did, the attorney gets paid by the court if there is an award, more likely a remand. Lawyers come out of the woodwork when they see your CAVC docket number. I know now that they have to find any technicality to get it remanded and make the money. I bet I had 30 letters from different law firms when my docket number showed up.

But the minute they win (at CAVC), you are on your own again.

just have a question

what do i do if i get dropped by lawyer ??

do i have to pay a bill

do i get my records back??

also i see on other web sites vets getting dropped by their lawyers i guess the lawyer gets paid out of some federal fund

it appears to me the lawyers are opting out and filing to get the fee out of this vja fund rather than waiting 6 - 7 years to see if the vet wins

any advixe on who to get for a lawyer in case i get dropped?? lot of lawyers aer opting out to get the cash rather than waiting for a case

Bargmann anfd moore seem to mentioned a lot??

thx

    • Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!

My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.

Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!

    • I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even  reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it. Just about twenty question, and  nothing about stressor,
    • This is the latest Compensation & Pension (C&P) Clinicians Guide dated 20180719. The only other one I've seen is dated 2002, including the one on this website and the VA website. I got this from my claims agent, who got it from the VA.
