What's The Difference Between Cue And The 1151 Claim?

CUE alleges error on the part of the decision makers for the decision. (Veterans benefit administration)

1151 alleges error on the part of the medical center. (Veterans health administration)

If your error is a rater made an error, then its CUE.

If your error is a doc made a mistake, then its 1151.

Technically you could have a cue claim that concerns an 1151 claim...

A CUE claim is one one where a resonable person can conclude that a decison on a claim was incorrect based on the record at the time of the decison.

An 1151 claim is the VA's term for a medical malpractice claim.. and based on my expierence almost impossible to prove because of the way the laws are written.....
