Question

first I want to say I do trust my NSO. However I ask that you read my letter to him and his to VA asking for entitlements. I think some things are missing but it could just be me. Like asking for more than 40% for fibro but 40% is the max allowed? Gastris no mention of hiatal hernia or barretts esophagus? and keratoconus no asking for a % and the effective date is wrong?

My national VSO did my NOD the same way. Just state which issues to which I dispute.

Frankly, I agree with you. Dont just say, "I think I deserve more than 40%" but state why. "I think I deserve more than 40% BECAUSE Doc x, (on 4-12-2011) stated that I had symptoms y, and z, which are part of the criteria for 70%.

Yes, you can do the "why's" to justify why you think you deserve a higher rating, but why wait?

First, its fresh in your mind and you may not remember in 6 months. More importantly, if you send the "why" you should get higher than 40%

"later", chances are good the VA loses that piece of paper. So, if its "in the NOD" the VA cant state "they lost" it.

I say do your NOD RIGHT the first time. Yes, if you have more evidence you can submit it later, but still do it right the first time. One attorney said it this way:

I never miss an opportunity to present my clients position in a favorable way each time I can.

So, yes, your nod is an opportunity to tell your side of the story and you should take full advantage of that. I disagree with this and other VSO's "generic" NOD's which are really incomplete, and assumes you will make your case and give the "why's" later. Why procrastinate on something as important as your benefits?
