Fast Bva Action?

Question

Read a lot on some of the VA sites and BVA stuff seems to go real slow. Dosen't this seem really fast to go from SOC, VA From 9 to BVA & back or am I missing something??

Caption says they mailed me and my VSO the decision, but I have not received anything...

Excerpts from Ebenifits:

  • Power of Attorney: D - DAV
  • Current Progress: Decision & Claims File Dispatch
  • Current Progress Description: Your case has been received at BVA, and BVA has mailed your decision to you (and your representative, if any) and will be returning your claims file to the VA Medical Center. Please note that transit times vary, and there may be some lag time between when BVA forwards your claims file to its appropriate location and when that location receives it.

2/15/2011 Local VA Office Decision RO

4/22/2011 NOD RO

4/29/2011 Appeal Pending BVA

He references the VA form 9, but the "date of progress - progress office" listing of documents and actions(that I assume he has pulled from the EBenefits website) does not list it.

That is why I asked if he had the proof of Mailing/signed receipt for delivery.

It sure doesn't look like they have acknowledged the receipt of the Form 9 in that transaction log.

Copied this info from the EBennifits website and no return receipt requested, but I did send the VA Form 9 Certified Mail. Also, no change on AB8 or Bennefits Explorer. And, the site says decision was made on 11-30-12(Friday) and Dispatch sent 12-01-12 (Saturday???).

I would resend the From 9 with a cover letter and a copy of the certified mailing receipt. In the letter ask them to confirm receipt of the form 9 sent earlier as evidenced by the copy of the Certified mail receipt.

eBenefits will say Decision and Claims File dispatch even for things that were timed out (no form 9 received). When something closes out because you did not send in the form 9 (I know you sent it in, but it looks like they have not acknowledged receipt), they do not send anything out.

You could also call the 800 number(good luck with that).

Can never get thru on 800-827-1000 and when sending IRIS inquiries they answer them out of order sent. I made a copy of the VA Form 9 package and sending it signature required today. Thank you so much for responding with your insight. I thought something didn't look right about this.
