Had Tele-Cast With Va Neurologist

I'M APPEALING MY PARKINSON'S EFFECTIVE DATE AND HAD A TELE-CAST INTERVIEW WITH PARKINSON'S SPECIALIST AT RICHMOND. VIRGINIA. HE ASK ME A BUNCH OF QUESTIONS AND HAD ME TO DO SEVERAL PHYSICAL THINGS AND HE TOLD ME THAT I HAVE HAD PARKINSON'S FOR AT LEAST FIFTEEN YEARS. I ORIGINAL FILED FOR NEUROLOGICAL DISABILITIES IN 2002, WITH CLASSICAL PARKINSON'S SYMPTOMS. I DIDN'T MENTION THE WORD PARKINSON,S IN 2002. THE VA APPROVED ME FOR PARKINSON'S WITH AN EFFECTIVE DATE OF 4-15-2011, SAYING I WAS NOT DIAGNOSED WITH PARKINSON,S UNTIL APRIL 2011. WHAT I WAS WONDERING, WITH THE VA SPECIALIST IN RICHMOND SAYING THAT I'VE HAD PARKINSON'S FOR AT LEAST FIFTEEN YEARS, COULD THIS BE CONSIDERED AS A DIAGNOSES.

To me the next thing to do is to get a copy of the VA specialist's diagnosis/notes, etc.

If the symptoms were present and listed earlier than you were given an EDD, and there is reason to believe the VA made a legal error,

you have a chance. Collect all the information you can get, and see a VA claims lawyer.

If the VA had the medical information, failed to diagnose, and that caused you harm, it's possible (not necessairly probable)

that you might be able to get something done.

I agree with chuck75 and john what were rated for in 2002? It could be that you can make them CUE themselves for misdiagnosis in 2002 especially if the neuro you just saw said you've had it for at least 15 years. JMO

A new diagnosis is not CUE. However, a Vet is not a doctor and cannot make decisions medical in nature (Espiritu)

IT WAS NOT AN IMO. I DON'T KNOW WHAT THEY CODED ME FOR AND I GUESS MY RATE WAS 0%. MY CLAIM WAS FOR NEUROLOGICAL PROBLEMS AND PARKINSON'S IS A NEUROLOGICAL DISEASE. AS A LAY PERSON I DIDN'T KNOW I HAD PARKINSON'S. NEHMER SAYS IF IT CAN BE CONSTRUED AS THE SAME DISEASE, THAT I SHOULD HAVE RECEIVED RETROACTIVE PAY BACK TO 2002. I WROTE VA A LETTER ASKING FOR ALL OF THE INFORMATION ON MY 2002 CLAIM AND ALL THEY SENT ME WAS A COPY OF MY CLAIM. I'VE GOT A FEELING THAT THEY DIDN'T CODE ME FOR ANYTHING. HOW DO I GET A COPY OF THE VA SPECIALISTS NOTES, HE IS IN RICHMOND VA, AT ONE OF VA'S FIVE PARKINSON'S NATIONAL SITES AND I,M IN WEST VIRGINIA. THANK YOU ALL FOR RESPONDING TO MY POST

Since we are talking about years of potential retro I would do as Chuck says and get a lawyer to look at this rather than beating yourself to death trying to do it on your own. If the lawyer sees potential money he will work to get it, and he knows the law.
