Question

All,

Not for me, but my wife. She was denied today for her Social Security Disability Claim. I'm sure she has a claim and could win with the right lawyer. I did read how they are compensated, so I understand that part.

Her initial claim was for Chronic Pain Syndrome from bialteral knee surgery, for which she is diagnosed with, however, not on the Social Security list of maledies. She had many more complications and medical issues and we could have proceeded in the wrong direction with the (1st/initial) claim.

Anyway, we (she) has 60 days to request an appeal.

Any help would be appreciated,

Actually going to Mayo Clinic in Rochester today. She is having 2 minor (but compicated) surgeries tomorrow.

Also - if you are on SSDI, you get Medicare after you have been receiving benefits for 24 months. The waiting period doesn't count here. So it is 24 months after you have actually been entitled to receive benefits.

Why the Federal Government decided that disabled individuals who are no longer working should go two years without health insurance is a mystery to me. It would seem like health care would be one of the first things they would provide.

Thanks for the info. I have read some on my own also. She is 48 and the under 50 criteria is a little tougher. We'll have to wait and see.

I'm sure there is a reason for the two year wait for medicare, just not sure what it is.

All,

Well, its been seven months now since we sent in the reconcideration and haven't heard a word. She had been to another doc, this time a MS only doc, who did confirm her progressive ms. That makes three, now, one neurologist and two ms specialists. Her neurologist did mention that SSDI was in contact with her and that she told them that she had sent my wife for the second opinion and that it was positive, but did not comment on anything related to benifits, etc. Also, her PCP and her physical theropist both are telling her she can not drive anymore, at all. She was driving 3-4 miles, but now that is out. She falls asleep all of the time.

Now, don't laugh, but you have to have some laughter when this is happening to you. She did laugh too, so its just not me. Anyway, I left for work the other day and she was still at the diner table (I work nights), and I came home from work and she had a red mark around her left eye. I asked her what happened and she said after I left for work she fell asleep eating and when she woke up her face was down against her drinking glass around her eye. She had slept like that for about two hours. We did laugh. Sometimes you have to.

Hope we get some news on this front soon, and hope everyone is getting ready for turkey day!!

Wife called the Chicago office today as they had her claim because Madison, WI was over loaded and farmed hers out. The person stated that her reconsideration case was closed and sent to the local office in Rhinelander WI. She told my wife she could not state whether it was approved or not, only that it was closed and sent to the local office.

Does anyone know if your denial would come from the local office or not. Our first denial we are unsure of were it came from because we kept the letter and threw away the envelope.

Anyway, they are supposed the send us a letter according to the person on the phone.

Should know something soon.

All,

We contacted Allsup last week and they were very nice over the phone. It was late in the day so she called back 0900 the next morning and her, my wife and SS had a conference call to determine my wifes benifit is she would win the claim and if she was eligible, I guess.

I did try two different lawyers, one close to us, and one that specialized in MS, however, we never got a call back or e-mail from either.

Allsup answered with a person after about a 5 minute wait.

We will see how this works?
