REVIEW OF EVIDENCE Compensation

Evidence Requested is Past Due

Development Letter Sent FOR 3 WEEK NOW

Degenerative changes of the PIP joints second and 3rd MCP
joints.

There is deformity of the 5th metacarpal. Appearance consistent
with remote trauma

XR. left wrist and left hand.

was 6/20/11 to 5/13/13 now 6/13/13 to 5/4/14

The VA doesn't intentionally delay claims though. You make it sound like they are out to make our lives hard or something. They process as fast as they can so they can move on to the next one. When you're speaking about numbers like millions and hundreds of thousands then of course there will be countless examples where people get screwed over. The government is pouring money into the system we should be glad to live in a country that does such.

If a claim is delayed over 10 years it means you have a very weak case for compensation. My claim took 4 months because the evidence was obvious and straight forward. The system works it just has a to filter out fraud and rightly so.

Your sweet little song about how great the VA is will change when they revisit you for reduction and severance. You will think they are the Mafia then.

I don't base my view of the VA as a whole based on individual cases. I'm saying the system as a whole is working to help Vets and not intentionally treating them "like dirt". If you believe the whole system is intentionally working to spite Vets then you are a conspiracy theorist who complains about any and everything.

I agree with Jaluluah 11B, and this is based on my experience as a veterans service officer, but if you have a claim that is 10 years old, your missing something and something big.

As you read the comments by broncovet throughout this site you will find nothing positive about anything by him. It's like the whole world (to include VA) has only one mission and that's to screw him anyway and everyway.

I am the first one to say that I believe each and every veteran deserves to be awarded what they deserve. But to argue and argue over what the definition of is is and how it applies is bogus....JMHO!!!!

WOOO! I'll stear clear of this one. Everyone has their opinion and we could argue apples and oranges all day long. The objective here is to ensure we are helping VETS regardless of our opinions. Even in negativity we can still learn something. If you see who wrote it and don't like it don't respond to it. See how easy that was LOL.

The longer you deal with the VBA the more jaded you get. For me it has been 42 years and they have pulled every dirty trick in the book, and a lot of just "don't give a shit". I am a RVN vet so I am used to shit from the VA. They are better than they used to be I can say that. The VBA is a big machine. It is not like the PCP you see who knows your name and cares a little bit.

I have to completely disagree with your post about

I have no idea what hat you've pulled this rabbit out of ?

If the statement held any truth then we wouldn't have VBA claimants

in receipt of compensation retro's for hundreds of thousands of dollars.

Do you equate 'a weak case' with:

a) claims and evidence that va employees purposefully shredded

in order to meet quotas and improve statistics thereby perhaps receiving bonuses.

b) claimants not having C&P exams scheduled in a timely manner.

c) C&P exams that are required to be done by a specialist -

not being scheduled with a specialist.

d) evidence not being included in the record - but contained within

the claimants c-file

e) hearing request not being acknowledged and scheduled prior to

a SOC or SSOC.

etc . . . etc . . . etc . . .

Your claims ONLY took 4 months because everything needed was there

and you WERE - VERY LUCKY !

And for you to even mention,

is nothing more than a slap in the face to the majority of veterans.

That's like trying to blame the vets that receive convalescence compensation

for getting overpaid past say their 6 months or so - - -

because va failed to schedule a timely re-exam.

VA has done some very fine work - but as any large agency, they've had some bad apples

and done some shoddy work as a dis-service to veterans.

I'm sure you've not bothered to notice that when va disallows a claim issue and a NOD is filed

and a DRO De Novo Review or DRO hearing is held, and a form 9 is submitted resulting in the

claimant waiting another 2-5 years for an outcome from BVA, and the BVA's decision is to grant the issue -

several years have passed, many times as mine more than a decade . . .

plenty of money is involved - and va pays no interest - no interest and claimants have lost homes,

vehicles, families, etc . . . - yea - the vba is just wonderful all of the time - I call BS on this.

JMHO

Carlie passed away in November 2015 she is missed.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
