Claim Approved On Sunday 29 September!

Question

E-benifits is showing that my claim was completed-notification. However its not showing anything in explorer, any increase-just the old rating with the last date. As this was completed on a Sunday 29th(phoenix working 7 days a week) would it take a while or perhaps not show up? One of the claims was for temp 100% for my cervical surgery!

Well, I guess no pay or anything approved. Not even showing if I get the temp 100%-so I guess that was shot down too!

SO, I got the decision letter today. THey are only giving me 2 months not 3 months for house bound. THe rude agent Gabreil told me I would have to fill out a NOD to get the other month. I sent them a letter with the 1 month extension and faxed it!

THEY also said the following conditions weren't related to your military service so service connection couldn't be granted-

Chronic fatique sundrome associated with cervical strain

Bilateral upper extremity peripheal NP (also claimed as bilateral carpal tunnel syndrome) associated with cervical strain

Bilateral lower extremity peripheral NP associated with cervical strain

A member recommended that I have-The rating criteria for your cervical strain should be updated to be rated as Spinal Fusion based on the fact that you had fusion. A process where a bone is placed between two vertabrate. This fusion process is actually arthritis working for you because the bone fuses to the other bone over a period of time. The rating criteria for IVDS or Strain is different as it requires periods of bed rest or incapitating episodes over a period of time to get a higher rating.

How should I do this? A NOD or Cue? THe cervical strain is on appeal as it was given a 0 % 3 years ago. When this is ever looked at will someone adjust the % on this or do I had the cervical strain to be rated as Spinal fusion now as a DRO or with the appeal. The confusing part is I had an appeal on this for several years, and then had to get surgery on this in July so obviously no one wants to deal with this.

I guess since I have the letter, I probably will expect a deposit in the bank shortly as the surgery was in mid July, and the VA says only August & September. O I would expect 2 months to hit shortly. Better then nothing.

All the service connections that were denied for secondary to cervical say cervical strain. Would I file another claim or DRO station since I had surgery, the strain needs to be changed to fusion & all previous claims should be approved-thanks.

NOD. Get Craig Bash to look at it and have him spell it out to the Morons at your RO.

They are not seeing the radiculpathy (carpal Tunnel)

The rating letter said that as I had an appeal in for cervical(3 years now of 0%) they couldn't touch that as it is out of there hands! THe appeal of the original disability percentage for cervical spine, or arteriosclerotic heart disease or neurogenic bladder, which are all under appeal and outside the jurisdiction of the rating board.
